1. About these Terms
These Membership, Booking and Participation Terms (the “Terms”) form an agreement between BOCO Collective Ltd trading as TLS Wellbeing (“TLS”, “we”, “us” or “our”) and the person purchasing, booking or participating in a TLS membership, pay-as-you-go session, course, workshop or event (“you” or “the participant”).
Our address is Unit 4B, Skelmanthorpe Technology Park, off Standback Way, Skelmanthorpe, HD8 9GA. You can contact us at info@thelifestylestudios.com.
These Terms apply alongside the description, price, payment schedule and any product-specific conditions displayed at the point of purchase. If the participant is under 18, a parent or legal guardian must accept these Terms on their behalf and remains responsible for the participant’s compliance with them.
2. Your health and suitability to participate
You are responsible for deciding whether an activity is suitable for you and for giving complete and accurate answers to TLS’s health questions. You must tell TLS before taking part if you have an injury, pain, illness, medical condition, disability, pregnancy, recent surgery, medication effect or other circumstance that may affect safe participation.
You must update TLS promptly if your health or circumstances change. If there is any doubt, you should seek advice from an appropriately qualified healthcare professional before taking part. TLS may reasonably ask for medical clearance, recommend an adaptation, or defer or refuse participation where this is necessary for safety. A coach’s guidance is not medical advice.
3. Exercise risks and your responsibilities
Physical activity carries inherent risks, including fatigue, muscle soreness, strains, sprains, falls, collisions and, more rarely, serious injury. You agree to:
work within your own ability and stop if you feel pain, dizziness, faintness, unusual shortness of breath or become unwell;
follow reasonable coaching, safety and equipment instructions;
use equipment only as instructed and report faults, hazards, accidents or injuries immediately;
wear suitable clothing and footwear, remain appropriately hydrated and avoid participation while impaired by alcohol, drugs or medication; and
behave respectfully and not endanger, intimidate, harass or disrupt other people.
In an emergency, TLS may contact the emergency services and the emergency contact recorded on your account.
4. Memberships
4.1 The membership type, price, included services and payment frequency are those shown at checkout. Membership access is personal to the named member and may not be shared or transferred unless TLS agrees in writing.
4.2 Rolling memberships have an initial minimum term of three months from the membership start date. You are responsible for all payments due during that minimum term, whether or not you attend.
4.3 After the minimum term, the membership continues on a rolling monthly basis until cancelled. To cancel, email info@thelifestylestudios.com giving at least 30 days’ written notice. You may give notice during the minimum term, but the cancellation cannot take effect before the end of the three-month minimum term. Payments falling due during the minimum term or 30-day notice period remain payable.
4.4 Memberships cannot be routinely paused for holidays, work commitments or non-attendance.
4.5 If a significant injury, illness or pregnancy prevents you from using the membership, contact TLS as soon as reasonably possible. TLS will consider a fair freeze or early cancellation from the date of the request and may ask for reasonable supporting information from an appropriate healthcare professional. Any decision will take account of the circumstances and applicable consumer law. Freezes will not normally be backdated.
4.6 You must keep a valid payment method on your account. If payment fails, TLS may retry collection and may suspend access while an amount remains overdue. TLS will give reasonable notice before using any debt-recovery process. This does not affect your right to dispute an incorrect payment.
4.7 If TLS proposes a material change to the price or core benefits of a rolling membership after the minimum term, it will give reasonable advance notice. If you do not accept a material adverse change, you may cancel before it takes effect without an additional cancellation charge, subject to sums already properly due.
5. Online cancellation rights
If you purchase a membership or service online or away from TLS’s premises, you may have a legal right to cancel within 14 days after the contract is made. To exercise that right, send a clear statement to info@thelifestylestudios.com before the cancellation period ends.
If you expressly ask TLS to begin providing the service during the 14-day period and then cancel, TLS may charge a proportionate amount for services supplied before cancellation, where the law permits. Once a service has been fully performed following the required request and acknowledgement, the right to cancel may be lost. These statutory rights are separate from the membership cancellation terms above.
6. Class and PAYG bookings
6.1 Places are subject to availability and must be booked through the method specified by TLS.
6.2 A PAYG class or open-gym booking may be cancelled or rearranged without charge if you do so at least 24 hours before its scheduled start time, using WodBoard or by contacting TLS.
6.3 If you cancel with less than 24 hours’ notice or do not attend, the booking payment or credit is forfeited and is not refundable, unless consumer law requires otherwise or TLS agrees an exception in genuinely exceptional circumstances.
6.4 Membership class-booking rules, including any fair-use, late-cancellation or no-show controls, will be displayed with the relevant membership or communicated separately. TLS will not impose a new financial charge unless it has been clearly disclosed and agreed.
7. Events, workshops and courses
7.1 Event, workshop and course bookings are non-refundable if you cancel or do not attend. They may not be transferred to another person unless TLS agrees in writing. This does not affect any statutory cancellation right that applies.
7.2 If TLS cancels an event and does not provide a suitable alternative, it will refund the amount paid for that event. If TLS makes a material change to the date, location or nature of an event, it will offer a reasonable alternative, credit or refund as appropriate. TLS is not responsible for separate travel, accommodation or other costs except where the law requires.
8. Timetable, coaches and facilities
TLS may make reasonable changes to timetables, coaches, class formats, equipment or facilities. A particular coach, space or class time is not guaranteed. Where TLS cancels a PAYG booking, it will offer a rearranged session, credit or refund. Where disruption materially reduces an ongoing membership service, TLS will act fairly and consider an appropriate remedy.
9. Conduct, access and property
TLS may refuse or end a session, suspend access or terminate an agreement where this is reasonably necessary for safety, serious or repeated misconduct, abusive behaviour, material breach of these Terms or persistent non-payment. Where appropriate, TLS will explain the concern and give the customer a reasonable opportunity to respond or put matters right. Any refund or balance due will be handled fairly and in accordance with consumer law.
Please secure personal belongings. TLS is not responsible for loss or damage it did not cause, but nothing in these Terms excludes liability where loss or damage results from TLS’s negligence or where liability cannot lawfully be limited.
10. Personal data, health information and images
TLS uses personal information to manage accounts, bookings, payments, safety and service communications in accordance with its privacy notice. Health information is sensitive personal data and will only be collected and used where TLS has an appropriate legal basis and condition under data-protection law. Where explicit consent is relied upon, it will be requested separately and recorded.
Any consent to photography, video, testimonials or marketing must be optional and separate from acceptance of these Terms. Refusing optional marketing consent will not prevent you from buying or using TLS services.
11. Liability and your legal rights
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
TLS is responsible for loss or damage that is a foreseeable result of its breach of these Terms or failure to use reasonable care and skill. TLS is not responsible for loss or damage that is not caused by its breach or negligence, was not reasonably foreseeable when the contract was made, or relates to a participant’s business or commercial activity. Your statutory rights as a consumer are not affected.
12. Complaints and general terms
Please raise concerns promptly with a coach or email info@thelifestylestudios.com. TLS will try to investigate and respond fairly within a reasonable time.
If any part of these Terms is found unenforceable, the remaining parts will continue to apply. A delay in enforcing a right does not waive that right. These Terms are governed by the law of England and Wales. You may bring proceedings in the courts that have jurisdiction under applicable consumer law.
