IMPORTANT: PLEASE READ CAREFULLY
By signing this document, you acknowledge that you are voluntarily participating in activities at The Stronghold Fitness Limited and agree to the terms set out below.
1. ASSUMPTION OF RISK
I understand that participation in functional fitness activities involves inherent risks that cannot be eliminated regardless of the care taken by the facility, its owners, coaches, employees, contractors, or agents.
Activities may include, but are not limited to:
- Olympic weightlifting and powerlifting
- Pull-up bar exercises, gymnastics movements, and hanging exercises
- Box jumps and plyometric training
- Running, rowing, cycling, and conditioning activities
- Kettlebell, dumbbell, barbell, and resistance training
- Mobility, stretching, and flexibility exercises
- Group fitness classes
- Open gym and self-directed training sessions
- Any other fitness, strength, conditioning, or functional training activities conducted at the facility
I acknowledge that these activities may involve risks including, but not limited to:
- Muscle strains and tears
- Sprains and ligament injuries
- Fractures and broken bones
- Cuts, bruises, and abrasions
- Head injuries and concussion
- Falling from equipment or during exercise
- Dropping weights or equipment
- Equipment malfunction or misuse
- Serious injury, permanent disability, paralysis, or death
I voluntarily assume all risks associated with my participation.
2. HEALTH DECLARATION
I represent and warrant that:
- I am physically capable of participating in the activities offered by the facility.
- I do not have any medical condition that would make participation unsafe unless I have obtained medical clearance from a qualified healthcare professional.
- I will immediately inform a coach or member of staff if I experience dizziness, pain, illness, discomfort, or any unusual symptoms before or during training.
- I understand that the facility does not provide medical advice and that it is my responsibility to seek appropriate medical guidance regarding my fitness to participate.
3. OPEN GYM AND UNSUPERVISED TRAINING
I understand that when using the facility during open gym or self-directed training periods, I am responsible for selecting, performing, and monitoring my own exercises.
I acknowledge that staff may not be actively supervising my workout during these periods and that I assume full responsibility for my actions, exercise choices, and use of equipment.
4. RELEASE OF LIABILITY
To the fullest extent permitted by law, I release, waive, discharge, and hold harmless the facility, its owners, directors, officers, employees, coaches, contractors, volunteers, agents, and affiliates from any and all claims, demands, actions, damages, losses, liabilities, costs, or expenses arising out of or related to:
- My participation in any activity at the facility;
- My use of equipment or facilities;
- Any injury, illness, property damage, disability, or death arising from participation.
This release applies whether arising from participation in coached classes, open gym sessions, special events, competitions, or any other activity conducted by the facility.
5. EQUIPMENT USE
I agree to:
- Use all equipment responsibly and only for its intended purpose.
- Follow instructions provided by coaches and staff.
- Stop using any equipment I believe may be unsafe and immediately notify staff.
- Return equipment to designated storage areas after use.
6. FACILITY RULES
I agree to comply with all facility rules, policies, and staff instructions.
I understand that the facility reserves the right to refuse entry, suspend membership, or terminate participation if my conduct creates a safety risk to myself or others.
7. EMERGENCY MEDICAL TREATMENT
In the event of injury, illness, or emergency, I authorise the facility and its representatives to seek emergency medical assistance on my behalf if deemed necessary.
8. PERSONAL PROPERTY
I understand that I am responsible for my personal belongings and that the facility is not responsible for lost, stolen, or damaged property.
9. SEVERABILITY
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. ACKNOWLEDGEMENT
I confirm that:
- I have read and understood this Waiver, Release of Liability, and Assumption of Risk Agreement.
- I understand that by signing this document I may be giving up certain legal rights.
- I am signing voluntarily and without coercion.
- I am at least 16 years of age, or if under 16, a parent or legal guardian has signed on my behalf.
