GRIT FITNESS LTD – WAIVER, RELEASE & MEMBERSHIP AGREEMENT
This Agreement is between GRIT FITNESS LTD, Unit 10 Peacefield Business Park, Holton Le Clay, DN36 5HS (“the Gym”) and the undersigned member or guardian (“the Member”).
1. Definitions and Eligibility
A Member is someone with an active membership agreement.
An Open Gym User is someone accessing facilities outside of structured classes.
A Minor refers to anyone under the age of 18.
A Child Member refers to anyone under age 16.
By signing this Agreement:
I confirm that I am 18 years of age or older, OR
If under 18, I have a parent/guardian’s consent below, and
I understand that persons under 16 may not sign up for a membership.
2. Acknowledgement of Risk
I understand that participation in CrossFit, strength training, fitness classes, and any gym activities carries inherent risks of injury, including but not limited to sprains, strains, fractures, cardiovascular events, or other serious injury.
I voluntarily assume all risks associated with participation and use of Gym facilities, whether during staffed or unstaffed hours.
3. Minors, Classes, and Supervised Activities
Persons under 18 may not use Open Gym facilities at any time.
Persons under 16 may not hold a membership; they may only participate in designated fitness classes for minors with a parent/guardian present where required.
Minors participating in classes must have appropriate consent and a parent/guardian contact on file.
Supervised classes for minors will be subject to additional safety information and consent questions where required.
4. Waiver and Release of Liability
To the maximum extent permitted under UK law, I, on behalf of myself and my heirs, executors, and assigns, hereby release, waive, and forever discharge GRIT FITNESS LTD, its directors, officers, employees, agents, representatives, and contractors from any and all liability for any loss, damage, injury, or expense (including death) that may arise as a result of my participation in any gym activities or use of facilities.
This waiver applies whether activities are supervised or unsupervised.
5. Assumption of Responsibility and Fitness to Participate
I represent that:
I am in good physical health,
I have no known health condition that would make exercise unsafe, and
I will consult a qualified medical professional before participating if I have any doubt.
I understand that it is my responsibility to exercise within my own limits.
6. Indemnification
I agree to indemnify and hold harmless the Gym, its staff, contractors, and agents from any claim, loss, damage, or expense arising out of my negligent acts or failure to follow Gym policies, instructions, and safety guidelines.
7. CCTV, Data Protection and Privacy
I acknowledge that the Gym is monitored by CCTV for safety and security. I consent to being recorded while on the premises. I understand that personal data and recordings will be processed in accordance with the UK GDPR and Data Protection Act 2018 and the Gym’s privacy notice.
8. Payment for Goods and Services
I understand that any products such as drinks, supplements, merchandise, or other items offered by the Gym are not included in the membership fee and must be paid for separately and before consuming.
9. Membership Cancellation Policy
I acknowledge and agree that:
All memberships require a minimum 30-day written notice for cancellation.
I am responsible for paying membership fees for the entirety of the 30-day notice period.
No refunds will be issued for unused membership time during the cancellation period.
10. Open Gym Use and Non-Member Policy
Only current members who are 18 or older may use Open Gym facilities.
Non-members must not access Open Gym without prior management approval and appropriate waivers completed.
Anyone found using Open Gym without authorization may have membership privileges revoked and could be liable for trespass.
11. Gym Code of Conduct
I agree to the following standards of behaviour while on Gym premises:
Respect all members, staff, guests, and property.
Wear appropriate footwear and gym attire at all times.
Use equipment safely and for its intended purpose.
Wipe down equipment after use.
Re-racking weights and keeping training areas clean.
No foul, abusive, discriminatory, or offensive language or behaviour.
No dangerous, unsafe, or irresponsible conduct.
Follow all instructions given by Gym staff and comply with posted rules.
Report any unsafe conditions or injuries to staff immediately.
Do not bring non-members into staffless areas without permission.
Failure to follow the Code of Conduct may result in suspension or cancellation of membership.
12. Governing Law and Severability
This Agreement shall be governed by the laws of England and Wales. If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
