PARTICIPATION AGREEMENT, ASSUMPTION OF RISK & LIABILITY WAIVER

1. Definitions
CrossFit Hull Limited, CrossFit Humber Limited and Brough Community LTD shall together be referred to as “the Company”.

2. Acknowledgment of Risk
I agree to participate in physical training activities provided by the Company, including but not limited to CrossFit training, strength and conditioning, and general fitness programmes.

I acknowledge that these activities are physically demanding and involve inherent risks, including but not limited to:

- Injury to the musculoskeletal and/or cardiovascular system
- Serious injury or death
- Injury arising from equipment use or failure
- Injury caused by myself or other participants
- Injury arising from known or unknown medical conditions

I understand that participation may result in abnormal blood pressure, fainting, heart rhythm disorders, stroke, heart attack, or, in rare cases, death.

I voluntarily accept and assume all inherent risks associated with participation.

3. Medical Declaration
I confirm that:
- I am physically fit and able to participate in strenuous exercise
- I have disclosed any medical conditions via the Company’s systems
- I will seek medical advice prior to participation if unsure of my fitness
- I will stop exercising immediately if I feel unwell

4. Unmanned Facility Use, Access Control & CCTV
I understand that the facility may operate at times without staff present.

I agree and acknowledge that:
- Access to the facility is strictly personal to me
- I will only use the dedicated access code or entry method issued to me by the Company
- I will not share, distribute, or allow any other person to use my access code or gain entry using my credentials
- I will not admit or allow entry to any non-member or unauthorised person under any circumstances
- Any breach of access rules may result in immediate termination of membership without refund

I further understand and accept that:
- The facility is monitored by CCTV for safety, security, and compliance purposes
- CCTV footage may be used to investigate breaches of these terms, including unauthorised access or unsafe behaviour
- By entering the facility, I consent to being recorded for these purposes

During unmanned use, I further agree that:
- I train entirely at my own risk
- I am responsible for my own safety and conduct
- I will only perform exercises I am competent to undertake safely
- I will use all equipment correctly and as intended
- I understand that staff may not be present and immediate assistance may not be available in the event of injury or emergency

I accept full responsibility for my actions and safety whilst using the facility in an unmanned capacity.

5. Limitation of Liability
Nothing in this agreement excludes or limits liability for death or personal injury caused by negligence where such liability cannot be excluded under the laws of England and Wales.

Subject to the above, I agree that the Company, its directors, employees, and volunteers shall not be held liable for any injury, loss, or damage arising from risks inherent in participation in physical activity.

6. Participant Responsibility & Indemnity
I agree to exercise in a safe and responsible manner at all times.

I agree to indemnify and hold harmless the Company against any claims, damages, losses, or expenses arising from:
- My negligent or intentional acts or omissions
- Any breach of this agreement, including misuse of access credentials

7. Emergency Medical Treatment
I consent to receive first aid from appropriately trained personnel where available.

In the event of serious injury or illness, I authorise the Company to arrange emergency medical treatment where necessary.

8. Use of Images
I consent to the use of photographs and/or video footage of me for marketing and promotional purposes

9. Minors (if applicable)
If signing on behalf of a minor, I confirm that I am the parent or legal guardian and consent to their participation under the terms of this agreement.

10. General
- This agreement is governed by the laws of England and Wales
- If any provision is held invalid, the remaining provisions shall remain in full force
- This agreement is binding on my heirs, representatives, and assigns

11. Declaration
I confirm that:
- I have read and fully understood this agreement
- I understand the risks involved in participation
- I understand that I am giving up certain legal rights
