Waiver and Release of Liability
Express assumption of risk: I, the undersigned, am aware that there are significant risks involved in all aspects of physical training. These risks include, but are not limited to:
• Falls which can result in serious injury or death;
• Injury or death due to negligence on the part of myself, my training partner, or other people around me;
• Injury or death due to improper use or failure of equipment; • Strains and sprains.
I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s)/children.
I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participation in any activity or class while at, or under direction of, CW1 CrossFit.
I acknowledge that I/my child/ren have no physical impairments, injuries, or illnesses that will endanger others or me.
Release: In consideration of the above mentioned risks and hazards and in consideration of the fact that I/my child/ren are willingly and voluntarily participating in the activities offered by CW1 CrossFit, I, the undersigned hereby release CW1 CrossFit their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in this activity, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect. If I am signing on behalf of a minor child, I also give full permission for any person connected with CW1 CrossFit to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medial facility deemed necessary for the wellbeing of the child.
Indemnification: The participant recognises that there is risk involved in the types of activities offered by CW1 CrossFit. Therefore the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above-mentioned parties,
or anyone acting on their behalf, be required to incur legal fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless CW1 CrossFit, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by CW1 CrossFit, at the main building or abroad. This includes but is not limited to;
• Parks
• Recreational areas
• Playgounds
• Areas in the vicinity of the main building, and/or any area selected for training by CW1 CrossFit.
I have read and understood the foregoing assumption of risk, and release of liability and I understand that by signing it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission. I understand that by signing this form I am waiving valuable legal rights.
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organisation. Coronavirus is contagious and is believed to spread from person to person contact. As a result the government have recommended social distancing and have in many locations prohibited the congregation of large groups of people. CWONE has put into place preventative measures to reduce the spread of COVID-19, however CWONE can not guarantee that you or your child(ren) will not become infected with COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you may be exposed to or infected by COVID-19 by attending CWONE and that such exposure or infection may result in personal injury, illness, permanent disability and death. I understand the risk of becoming exposed or infected at CWONE may result in actions, omissions or negligence of myself and others, including but not limited to, CWONE employees, volunteers, program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability or death), illness, damage, loss, claim, liability, or expense of any kind, that I may experience or incur in connection with my attendance at CWONE. On my behalf and on the behalf of my children, I hereby release, covenant not to sue, discharge and hold harmless CWONE employees, agents, and representatives, of and from the claims, including liabilities, claims, actions, damages, costs or expenses of any kind arising out of or related thereto. I understand and agree that this release includes any claim based on the actions, omissions, or negligence of the gym, its employees, agents and representatives, whether COVID-19 infection occurs before, during or after participation in any of the CWONE classes/programs.
At CWONE we are a community. There are things that we can all do to ensure that we all have the best time at the box, make it a productive environment, keep each other safe and ensure that we get the best out of ourselves and others.
If you are pregnant or injured then please can you let a coach know so we can modify and adapt the workout before you arrive. We do our best to ensure that the box and equipment is kept clean and tidy.
Please try and ensure that you keep your training gear clean and free from bad odours. We have carpeted floors so dirty shoes will not be tolerated and you may be asked to take them off or leave. If you take your top off while training please use a towel to catch your sweat and if you use chalk ensure you place it outside or on a towel. Mopping up afterwards often means that the next class is manoeuvring around a wet area of slippery flooring.
Your membership is on a monthly rolling contract with a 30 day cancellation period.
If you should wish to leave, please message us directly and we can cancel it immediately. If you wish to downgrade or increase your allowance, please let us know and we will make the arrangement to adjust the membership. Sometimes we grant Grandfather rights to our long serving members. If you change memberships or cancel then re-join then such rights are lost and you will be charged the current membership rate.
We work differently to a regular ‘globo gym’ as our business model requires you to commit to you class amount in order to achieve your results. If members don’t improve then they won’t stay. Therefore a £5 charge is applied if you cancel off your class late or do not attend, regardless of whether there is a waiting list on the class. It isn’t fair on those that are on waiting lists that miss out but it is not JUST for that reason. It is worse if there were only 3 people on a class and 2 end up being a no show. It also acts as a means of accountability to assist you to use your allocation in order to receive your results. Late cancelations are 1 hour before class, with the exception of weekend classes which are 2 hours before and early morning classes 10pm the evening before. This ensures that those on a waiting list have the best opportunity to attend and train.
Always ensure you have checked in on the iPad before the class starts and don’t rely on the self-check in, or other members doing it for you. Please do NOT check in other members that are not in attendance.
We don’t offer any type of Train now pay later options so if your membership isn’t active, or your wish to drop in on a class please ensure you have booked and paid before it starts. We try to ensure that we have the best quality equipment at the box and replacing this comes at a cost. In order to keep our prices as low as possible and avoid membership increases please respect and look after the equipment. If you are
reminded not to drop a piece of equipment or stack it in a particular place it is for a good reason. It is either to protect the equipment or to ensure our safety so please take note. CWONE CrossFit is coach led classes and by signing with us you are agreeing to being coached and guided by the CWONE Team. We offer PT and Specialty courses throughout the year and you can seek 1-2-1 programming from any of our coaches.
You are not expected to blindly trust our team but if we are not the right fit for you and you are looking for more than the daily programming, unfortunately we are not somewhere you can follow coaching or programming from outside of CWONE in our centre. We need to ensure that the programming keeps you safe and you would not expect McDonald’s to let you eat your KFC in their establishment. We are a community of people from all walks of life and it’s what truly makes us more special than most other training centres. We help each other out whenever we can, we are respectful and kind to everyone, we encourage all other members in times of difficulty and we don’t finish or pack up before the last person has finished. The classes are an hour long so if you need to leave early let the coach know before the class starts, unless it’s urgent, i.e on call or a family emergency. The cool downs and finishers our part of the program and you should stay until the end. Please do your best to turn up on time as late attendance is a disruption to others and the nature of the Wodboard brief means you will have missed important information about the workout. We understand that life can get in the way but if late attendance is a frequent issue please book on to a later class or speak to us as there may be something we can assist with. If you experience not receiving your membership allowance please contact us immediately and we will do our best to rectify the issue. We are mindful of this and class sizes and timetables are always under review. If you are on a waiting list and you are planning on turning up in the hope there is space we will endeavour to accommodate you. If there isn’t space then unlimited members may be able to do the WOD in the open gym area but please be aware that equipment must be prioritised for the class. If using open gym please don’t disrupt the coach or class. The coach MAY be able to let you on if the WOD is not limited by equipment or space but if the WOD is very technical or requires the use of lots of equipment they will not be able to let extra people join the class.
If you are booked on a class please try and use that booking. If you attend for an earlier or later class you will need to cancel and rebook so that your spot is made available for someone else to train. Open Gym Area/PT room If you are using the Open gym area you are only to use the equipment within that area. If you need anything else please drop the team a message before training. The class or PT’s will always take priority over the equipment such as plates or the Erg machines. There is no perfect system other than working with each other the
best we can. If there is a recurring problem we will endeavour to buy more kit to ensure you have what you need. We all follow one program and there are many advantages to this but there’s also some disadvantages as well. Hopefully the bad is outweighed by the good. We all have different strengths and weaknesses and the ability to train more or less often. Therefore we will progress in different areas at different rates. The ideal program would be specific to each member but that would come at a significantly higher cost. So in lower moments please try to remember no program or system would suit everyone but will hopefully please the majority. You turned up and put the effort in and will have benefitted from it. Some days are more fun than others.
Please refer to the map in the member room as to where we can park on site. Please refrain from parking in other business owner’s spaces especially during the day. CWONE has to keep a good relationship with everyone else on the business park and this is the one thing that really upsets the other owners. They pay for their spaces and require access for themselves and customers. Lastly, please do your best to take everything home with you at the end of your class as we cannot be held accountable for loss of your belongings. If you do leave anything we will try and lock away valuable items and anything else will be placed in the lost property box in the member’s room. Please check it on a weekly basis even if you feel as though you haven’t left anything behind. If items start to smell, or we accumulate too much Kit, then it will have to be disposed of.
Lastly the fire exits are clearly marked and there is a Map in the members room.
