I wish to participate in the exercise and training program offered by 360 Ultimate Fitness Ltd.
I understand there are inherent risks in participating in a program of strenuous exercise. Consequently, I have been examined by a physician of my choice and have obtained his/her approval for my participation in a fitness program within sixty (60) days of the date set forth below.
No change has occurred in my physical condition since the date such approval was given which might affect my ability to participate in the fitness program. If a physician has not examined me, I agree to see a physician within sixty (60) days of the date set forth below to obtain his/her approval for my participation in a fitness program.
I agree that 360 Ultimate Fitness Ltd shall not be liable or responsible for any injuries to me resulting from my participation in the fitness program (whether at home, at the training studio, outdoors, or at a corporate, commercial, residential or other fitness facilities) and I expressly release and discharge 360 Ultimate Fitness Ltd and its owners, employees, agents and/or assigns, from all claims, actions, judgments and the like which I or my heirs, executors, administrators or assigns may have or claim to have as a result of any injury or other damage which may occur in connection with my participation in the fitness program, excepting only an injury caused by the gross negligence or intentional act of such person or persons. This Release shall be binding upon my heirs, executors, administrators and assigns.
I understand that I am not obligated to perform nor participate in any activity that I do not wish to do and that it is my right to refuse such participation at any time during my training sessions.
I understand that should I feel lightheaded, faint, dizzy, nauseated, or experience pain or discomfort, I am to stop the activity and inform my Trainer.
I understand the results of any fitness program cannot be guaranteed and my progress depends on my effort and cooperation in and outside of the sessions.
I understand that during a training session, my trainer may have to use Touch Training to correct alignment and/or to focus my concentration on a particular muscle area to be targeted. If I feel uncomfortable or experience any type of discomfort with Touch Training, I will immediately request that my trainer discontinue using this technique.
I understand that the usage of any nutritional supplements is done under my own will.
I understand that 360 Ultimate Fitness Ltd. may photograph and/or film their client events/sessions and I agree to allow them to use these pictures, films, and/or likenesses of me for promotional purposes. In the event I choose not to allow the use of the same for said purpose, I agree that I must inform 360 Ultimate Fitness Ltd of this in writing.
I have read the statements of this legal document, understood the statements of this legal document and agree with its terms and conditions.
I understand that this document is complete unto itself and that any oral promises or representations made to me concerning this document and/or its terms and conditions are not binding upon 360 Ultimate Fitness Ltd, its officers, agents and/or employees.
I have voluntarily signed it and executed it voluntarily with full knowledge of its meaning, significance and implications.
Do you feel pain in your chest when you perform physical activity?
Do you have a bone or joint problem that could be made worse by a change in your physical activity?
Do you lose your balance due to dizziness or do you ever lose consciousness?
Do you have high blood pressure, asthma, diabetes or a heart condition?
Have you had a recent surgery?
Have you had a recent pregnancy?
Do you take any medications that might affect your physical performance or well-being?
360 Monthly Membership – Your rights
Membership Access:
1. The monthly membership agreement starts once you have accepted the terms during the joining process which is after your trial sessions. By accepting the terms, you are agreeing to pay the agreed Monthly Membership Amount as discussed with you. These are discussed with you after the trial sessions and also confirmed via email which will include your payment instruction.
2. You may choose to start your membership either immediately or on a specific date of your choice. We will inform you by email once this has been confirmed.
3. You are entitled to access and use 360 facilities defined by your membership provided you continue to pay your monthly membership amount. However, we reserve the right to change the access privileges of members where membership has lapsed or is in default. We will make reasonable endeavours to communicate to you in advance if we are unable to make available to you the rights and privileges of your membership.
4. Your membership will automatically renew on a monthly basis as per the agreement.
5. Your membership is subject to an annual price increase not to exceed 3% of the total billable monthly amount. This price increase will happen automatically on the yearly anniversary of membership
Cancellation Process
1. You have the right to cancel this agreement within 14 days from the start of the agreement without giving any reason but you must let us know you wish to do so within the 14-day period, this would need to be via email coach@360ufit.com .The cancellation period will expire after 14 days from the day you accept the terms. To meet the cancellation deadline, it is sufficient if you send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
2. In case of dispute you must show that you cancelled the agreement in accordance with the cancellation terms.
3. If you cancel your membership within the 14-day period, we will refund to you the membership amount you have paid less any amount in proportion to the number of days between the start of your membership and the date you communicated to us that you wanted to cancel during this 14-day period. Payment will be made not later than 14 days after the day on which we are informed about your decision to cancel using the same means of payment as you used for the initial transaction.
4. After the 14-day cancellation period you may terminate your membership with 30 days’ notice via email to coach@360ufit.com . The 30 days notice will be taken from the day we receive your cancellation email. Any prorate fee will be accounted for. For example, if you cancel on the 15th of May your membership will terminate on the 15th of June and you will only be charged a final prorate fee for 1-14th June and not the full membership amount.
Freezing/Upgrades/Downgrades/Discounts/Communication
1. You may freeze your membership from the 1st of month, for a period 1-3 month(s). During this freeze period your access to 360 will be suspended unless you choose to pay a drop-in fee for any extra days you wish to attend the gym inside your freeze period. There is a surcharge of £20.00 to freeze a membership for this period. You will not be charged your full membership fee only the £20.00 freeze charge.
2. You may upgrade your membership at any point during your contract providing you pay the additional fees subject to the new membership price. You may also downgrade your membership at any point during the contract this will take place from the next calendar month when your membership price will take effect.
3. If you join with a membership that benefits from a discount (whether or not temporary) to the monthly membership amount you will lose the discount and pay the advertised monthly membership amount if your membership is terminated and you choose to re-join at a later date.
4. You may opt-out of email and text communications that we may send but if you do we cannot be held responsible for any loss incurred by you not receiving 360-related communications.
