EXPRESS ASSUMPTION OF RISK:
I, the undersigned, am aware that there are significant risks involved in any physical training regimen. These risks include, but are not limited to: falls which can result in serious injury or death, injury or death due to negligence on the part of myself, my training partner, or other people around me, injury or death due to improper use or failure of equipment. Injury may also result simply from the fact of physical training itself. By its very nature, physical training seeks to have me push beyond my current physical limits in order to produce a physical adaptation by my body. This requires feedback from me to my trainer regarding what is happening with my body. Excessive work can result (in rare cases) in rhabdomyolosis. I should look for signs of excessive soreness, darkened urine, and pain in the kidney areas in the days following a particularly intense workout. I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s). I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participation in the workouts programmed by Quay Fitness, regardless of the location or conditions under which I perform the workouts. I, the undersigned acknowledge that I have no physical impairments or illnesses that will endanger myself or others.
RELEASE:
In consideration of the above mentioned risks and hazards and in consideration of the fact that I am willingly and voluntarily participating in the workouts programmed by Quay Fitness, I, the undersigned hereby release Quay Fitness, their principals, agents, employees, contractors, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in this activity, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect. If I am signing on behalf of a minor child, I also give full permission for any person connected with Quay Fitness to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the well being of the child.
INDEMNIFICATION:
The participant recognizes that there is risk involved in the types of activities offered. Therefore the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above mentioned parties, or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to Quay Fitness, their principals, agents, employees, contractors, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in workouts offered by Quay Fitness. I have read and understood the foregoing assumption of risk, and release of liability and I understand that by signing it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or legal rights.
Monthly memberships bill every month. Payment for the first partial period will be prorated according to the days remaining in the period. Some classes/events may be excluded from some memberships. Unless otherwise noted, membership is non-transferable. Your payment details will be securely stored in our system for the duration of the membership. This membership cannot be cancelled early.
Quay Fitness reserves the right to refuse your application for membership.
You are expected to treat the facility, its staff and its equipment with respect and failure to do this may result in your membership being cancelled.
By providing an email address members consent to receiving newsletters from Quay Fitness.
You must inform a member of staff if you feel that any piece of equipment within the gym is unsafe for use or if you have any other concerns whatsoever.
Opening hours and access are subject to change.
Abuse of membership, i.e. not paying fees when due, continued incorrect use of equipment, verbal or physical abuse of Quay Fitness or Personal Training staff, will result in the cancellation of the membership immediately and any outstanding fee's, costs from damage or legal fees will be sought from you via our collection agency.
During your membership monthly fees must be paid regardless of whether you use our services.
If we end or cancel your membership for any of the reasons listed here, we will not refund your bank and administration fee, starter payments, or monthly subscription.
By law, we do not have to pay you compensation for any service, facility or equipment not being available because of health and safety reasons or where it is for the benefit of your membership.
By law, we do not have to pay you compensation for loss or damage you may suffer unless we fail to carry out our duties under these terms and conditions to a reasonable standard or break any duties we have to carry out by law.
Cancellation Policy
We require 1 months notice on all cancellations.
Notice of cancellation should be given via email at the start of a calendar month.
Member Health Agreement :
You warrant, declare and acknowledge that:
The information given by you in entering this agreement is correct and will be relied upon by us.
Our staff, agents and subcontractors are not medically trained and should you have any concerns with your health and fitness you should seek independent medical advice before engaging in any physical activity on our premises.
To the best of your knowledge and belief you are in good health and not knowingly incapable of engaging in either active or passive exercise and that such exercise would not be detrimental to your health, safety, comfort, well being or physical condition. Further, that you will advise us immediately should your health or vulnerability to injury change.
You have read and understood this agreement and all of its the Terms and Conditions before accepting them below.
You are primarily responsible for your health and wellbeing, but we at Quay Fitness are concerned that you enjoy our facilities safely. To that end we consider that we should expect the following of each other.

Whilst we will respect your decision over your training regime we reserve the right to ask you not to exercise beyond what we reasonably believe to be your personal ability.
We shall endeavour to maintain a safe environment for you to enjoy your exercise.
We shall endeavour to ensure that our fitness trainers and staff are qualified to fitness industry standards.
We shall at all times keep confidential any information that you give us regarding your health.
If you are a wheelchair user we require you to have an induction at one of our venues to ensure your safe use of our facilities and equipment.
