CrossFit Aylesbury Terms and Conditions/ Waiver
Membership Terms and Conditions
This is an Agreement between you, the Member, and CrossFit Aylesbury. Our standard membership terms are set out below.
You agree to pay us the Monthly Membership Amount by direct debit whether or not there is any temporary interruption in services during the period whether foreseen or unforeseen.
Your first Monthly Membership payment is due on the 1st of the month.
You agree to maintain a direct debit instruction with your bank for the Monthly Membership Amount.
Subsequent Monthly Membership payments are due on the 1st of the month.
In order to cancel a DD payment you must provide us with 30 days notice (for non-medical reasons).
You agree to our cancellation policy, that if you cancel a class after the two hour class window or do not attend a class you booked into, you will automatically be charged a £2.00 cancellation fee. This fee is non-refundable.
If you would like to change your membership type you must notify us before the 25th of the moth prior to the month you wish your new membership type to commence.
Change in circumstance: DD payment can be cancelled without 30 days notice if at any time your circumstances change to such an extent that we are satisfied it is not possible for you to continue to use the CrossFit Aylesbury facility (for example, due to medical reasons or if you are made redundant). To cancel your membership for medical reasons, you will need provide the documents (a doctors/ or medical professional note) as proof of the change in your circumstances in order to cancel your membership at the end of that same month.
Waiver and Release of Liability
Express assumption of risk: I, the undersigned, am aware that there are significant risks involved in all aspects of physical training. These risks include, but are not limited to: falls which can result in serious injury or death; injury or death due to negligence on the part of myself, my training partner, or other people around me; injury or death due to improper use or failure of equipment; strains and sprains. I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s).
I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participation in any activity or class while at, or under direction of CrossFit Aylesbury.
I acknowledge that I have no physical impairments, injuries, or illnesses that will endanger me or others.
Release:
In consideration of the above mentioned risks and hazards and in consideration of the fact that I am willingly and voluntarily participating in the activities offered by CrossFit Aylesbury, I, the undersigned hereby release CrossFit Aylesbury, their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in this activity, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect.
Indemnification:
The participant recognises that there is risk involved in the types of activities offered by CrossFit Aylesbury. Therefore the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless CrossFit Aylesbury, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by CrossFit Aylesbury, at the main building or abroad. This includes but is not limited to parks, recreational areas, playgrounds, areas adjacent to main building, and/or any area selected for training by CrossFit Aylesbury.
I have read and understood the foregoing assumption of risk, and release of liability and I understand that by signing it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission.
I understand that by signing this form I am waiving valuable legal rights.
Photography:
Participants involved in any activities offered by CrossFit Aylesbury may be photographed or videotaped during training. The undersigned hereby consents to the use of these photographs and/or videos without compensation, on the CrossFit Aylesbury website or in any editorial, promotional or advertising material produced and/or published by CrossFit Aylesbury.
Regular physical activity is fun and healthy, and increasingly more people are starting to become more active every day. Being more active is very safe for most people. However, some people should check with their doctor before they start becoming much more physically active.
Common sense is your best guide when you answer these questions. Please read the questions carefully and answer each one honestly: tick YES or NO.
If you answered YES to one or more questions:
Talk with your doctor by phone or in person BEFORE you start becoming much more physically active or BEFORE you have a fitness appraisal. Tell your doctor about the PAR-Q and which questions you answered YES. CrossFit Aylesbury reserves the right to refuse to start or continue a client’s exercise program until a written medical approval has been provided by your doctor or health specialist.
Be aware that you should DELAY ANY EXERCISE ACTIVITY:
• if you are not feeling well because of a temporary illness such as a cold or a fever – wait until you feel better
• if you are or may be pregnant – talk to your doctor and a CrossFit Aylesbury Coach before you continue your exercise programme or start to become more active
IMPORTANT: If at any time your health status changes so that you would then answer YES to any of the PAR-Q questions or have to take prescribed drugs , it is your responsibility to inform a CrossFit Aylesbury Coach and ask whether you should change your physical activity plan and/or provide a Medical Clearance Form before continuing to exercise.
Has your doctor ever said that you have a heart condition and that you should only do physical activity recommended by a doctor?
Do you feel pain in your chest when you do physical activity?
In the past month, have you had chest pain when you were not doing physical activity?
Do you lose your balance because of dizziness or do you ever lose consciousness?
Do you have a bone or joint problem that could be made worse by a change in your physical activity?
Is your doctor currently prescribing drugs for your blood pressure or a heart condition?
Do you have any other health problem that causes you pain or limitations that must be addressed when developing an exercise program?
Do you know of any other reason why you should not do physical activity?
Are you pregnant now or have you given birth within the last 6 months?
Have you had a recent surgery?
Do you take any medications, either prescription or non-prescription, on a regular basis?
