INFORMED CONSENT/ASSUMPTION OF RISK:
BUYER ACKNOWLEDGMENT AND ASSUMPTION OF RISK AND FULL RELEASE FROM LIABILITY OF LIFT, LLC BUYER ACKNOWLEDGES THESE PHYSICAL ACTIVITIES INVOLVES THE INHERENT RISK OF PHYSICAL INJURIES OR OTHER DAMAGES, INCLUDING, BUT NOT LIMITED TO, HEART ATTACKS, MUSCLE STRAINS, PULLS OR TEARS, BROKEN BONES, SHIN SPLINTS, HEART PROSTRATION, KNEE/LOWER BACK/FOOT INJURIES AND ANY OTHER ILLNESS, SORENESS, OR INJURY HOWEVER CAUSED, OCCURRING DURING OR AFTER BUYER’S PARTICIPATION IN THE PHYSICAL ACTIVITIES. BUYER FURTHER ACKNOWLEDGES THAT SUCH RISKS INCLUDE, BUT ARE NOT LIMITED TO, INJURIES CAUSED BY THE NEGLIGENCE OF AN INSTRUCTOR OR OTHER PERSON, DEFECTIVE OR IMPROPERLY USED EQUIPMENT, OVER-EXERTION OF A BUYER, SLIP AND FALL BY BUYER, OR AN UNKNOWN HEALTH PROBLEM OF BUYER. BUYER AGREES TO ASSUME ALL RISK AND RESPONSIBILITY INVOLVED WITH PARTICIPATION IN THE PHYSICAL ACTIVITIES, BUYER AFFIRMS THAT BUYER IS IN GOOD PHYSICAL CONDITION AND DOES NOT SUFFER FROM ANY DISABILITY THAT WOULD PREVENT OR LIMIT PARTICIPATION IN THE PHYSICAL ACTIVITIES. BUYER ACKNOWLEDGES PARTICIPATION WILL BE PHYSICALLY AND MENTALLY CHALLENGING, AND BUYER AGREES THAT IT IS THE RESPONSIBILITY OF BUYER TO SEEK COMPETENT MEDICAL OR OTHER PROFESSIONAL ADVICE, REGARDING ANY CONCERNS OR QUESTIONS INVOLVED WITH THE ABILITY OF BUYER TO TAKE PART IN LIFT, LLC PHYSICAL ACTIVITIES. BY SIGNING THIS AGREEMENT, BUYER ASSERTS THAT HE OR SHE IS CAPABLE OF PARTICIPATING IN THE PHYSICAL ACTIVITIES. BUYER AGREES TO ASSUME ALL RISK AND RESPONSIBILITY FOR NOT EXCEEDING HIS OR HER PHYSICAL LIMITS.
INFORMED CONSENT/PHOTO & VIDEO RELEASE:
BUYER ACKNOWLEDGMENT GRANTING PERMISSION TO LIFT, LLC TO USE MY PHOTOGRAPHY/VIDEO IMAGE IN ANY AND ALL PUBLICATIONS RELATED TO THE USE OF FITNESS, INCLUDING WEBSITES, SOCIAL MEDIA, PUBLICATIONS , WITHOUT PAYMENT OR ANY OTHER CONSIDERATION IN PERPETUITY. I HEREBY AUTHORIZE LIFT, LLC TO EDIT , ALTER, COPY, EXHIBIT, PUBLISH OR DISTRIBUTE ALL PHOTOS AND IMAGES. I WAIVE ANY RIGHT TO ROYALTIES OR OTHER COMPENSATION ARISING OR RELATED TO THE USE OF THE PHOTOGRAPHY OR VIDEO IMAGES. I HEREBY HOLD HARMLESS AND RELEASE AND FOREVER DISCHARGE LIFT, LLC FROM ALL CLAIMS, DEMANDS, AND CAUSES OF ACTION WHICH I, MY HEIRS, REPRESENTATIVES, EXECUTORS, ADMINISTRATORS, OR ANY OTHER PERSONS ACTING ON MY BEHALF OR ON BEHALF OF MY ESTATE WHICH MAY HAVE OR MAY HAVE BY REASON OF THIS AUTHORIZATION.
INFORMED CONSENT/INDEMNIFICATION: *
BUYER ACKNOWLEDGMENT THAT THERE IS A RISK WITH ANY FITNESS PROGRAM INCLUDING THE PROGRAMS AT LIFT, LLC. THEREFORE I ACCEPT FINANCIAL RESPONSIBILITY FOR ANY INJURY THAT MAY CAUSE EITHER TO MYSELF OR TO ANY OTHER PARTICIPANT DUE TO HIS/HER NEGLIGENCE. SHOULD THE ABOVE-MENTIONED PARTIES, OR ANYONE ACTING ON THEIR BEHALF, BE REQUIRED TO INCUR ATTORNEY’S FEES AND COST TO ENFORCE THIS AGREEMENT, I AGREE TO REIMBURSE THEM FOR SUCH FEES AND COSTS. I FURTHER AGREE TO INDEMNIFY AND HOLD HARMLESS LIFT, LLC THEIR PRINCIPALS, AGENTS, EMPLOYEES, AND VOLUNTEERS FROM LIABILITY FOR THE INJURY OR DEATH OF ANY PERSON(S) AND DAMAGE TO PROPERTY THAT MAY RESULT FROM MY NEGLIGENT OR INTENTIONAL ACT OF OMISSION WHILE PARTICIPATING IN ACTIVITIES OFFERED BY LIFT, LLC.
By the execution of this agreement, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me or my guest, and I hereby fully and forever release and discharge LIFT, its insurers, employees, officers, directors, and associates, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out the use of said equipment and facilities.
I expressly agree to indemnify and hold LIFT harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by me or my guest.
I agree to comply with all rules imposed by LIFT regarding the use of the facilities and equipment. I agree to conduct myself in a controlled and reasonable manner at all times, and to refrain from using any equipment in a manner inconsistent with its intended design and purpose.
I understand and acknowledge that the use of exercise equipment involves risk of serious injury, including permanent disability and death. I understand and agree that LIFT is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises.
I understand and agree that my use of the facilities and equipment is only to be undertaken on my own personal time, and that my use of the facilities and equipment is not within the course or scope of my employment.
I HAVE READ THE FOREGOING WAIVER AND RELEASE OF LIABILITY AND VOLUNTARILY EXECUTED THIS DOCUMENT WITH FULL KNOWLEDGE OF ITS CONTENT.
LIFT TRAINING COLLECTIVE LLC - LIFT Code of Conduct
LIFT MEMBER CODE OF CONDUCT POLICY
LIFT Training Collective LLC (hereafter referred to as "LIFT") conducts regular sex offender screenings on all members, participants, and guests. If a sex offender match occurs, LIFT reserves the right to cancel membership, end program participation, and remove visitation access. In addition, LIFT reserves the right to deny access or membership to any person who has been accused or convicted of any crime involving sexual abuse, has ever been convicted of any offense relating to the use, sale, possession, or transportation of narcotics or habit forming and/or dangerous drugs, or is presently or habitually under the influence of dangerous drugs or chemicals, narcotics, or intoxicating beverages.
Members and guests are encouraged to take responsibility for their personal comfort and safety by asking any person whose behavior threatens their comfort to refrain from such behavior. Anyone who feels uncomfortable in confronting a person directly should report the behavior to a staff member on duty. LIFT staff members are eager to be of assistance. Members and guests should not hesitate to notify a staff member if assistance is needed. In order to be able to carry out these policies, we ask that members and guests identify themselves to staff when asked.
Suspension or termination of LIFT membership privileges may result from a determination by LIFT Managers if in their discretion a violation of LIFT Member’s Code of Conduct has occurred.
All fees paid for membership including Joining Fees are non-refundable.
MEMBER CODE OF CONDUCT
LIFT is committed to providing a safe and welcoming environment for all members and guests. To promote safety and comfort for all, all individuals are asked to act appropriately at all times when in our facility or participating in our programs. We expect persons using LIFT to act maturely, to behave responsibly, and to respect the rights and dignity of others. Our Member’s Code of Conduct outlines prohibited behavior, but the actions listed below are not an all-inclusive list of behaviors considered inappropriate in our facilities or programs:
Using or possessing alcohol or illegal chemicals on LIFT property
Smoking in LIFT facility
Carrying or concealing a weapon or any device or object that may be used as a weapon
Use of cell phones in LIFT’s shower and locker room areas
Use of any video/picture taking equipment by members, including camera phones, in LIFT’s shower rooms, locker rooms, and fitness center area
Harassment or intimidation by words, gestures, body language, or any type of menacing behavior
Physical contact with another person in an angry, aggressive or threatening way
Verbally abusive behavior, including angry or vulgar language, swearing, name-calling, or shouting
Sexually explicit conversation or behavior: any sexual contact with another person
Inappropriate, immodest, or sexually revealing attire
Theft or behavior that results in the destruction or loss of property
Loitering within or on the grounds of LIFT
In addition, LIFT reserves the right to deny access or membership to any person who has been accused or convicted of any crime involving sexual abuse, is or has been a registered sex offender, has ever been convicted of any offense relating to the use, sale, possession, or transportation of narcotics or habit forming and/or dangerous drugs, or is presently or habitually under the influence of dangerous drugs or chemicals, narcotics, or intoxicating beverages.
If a member or guest feels uncomfortable, they should report the behavior to a staff member immediately or to team@lifttrainingco.com. In order to carry out these policies, we ask that members and guests identify themselves when asked. A LIFT Manager will investigate all reported incidents. Suspension or termination of LIFT membership privileges may result if, in his or her discretion, a violation of the Code Conduct has occurred.
Facility Age Use Guidelines
The following rules are designed to ensure the safety of all members:
Children ages 10 and under are only allowed in our LIFT facilities while under the supervision of a parent
or guardian or registered and participating in a LIFT program
Members ages 11-14 may use fitness centers under the direct supervision of a parent/guardian
Parents of the opposite sex children over 5 years old must arrive at the gym already changed.
Accidents
Contact a LIFT staff person immediately if there is an accident, injury or unusual incident. We are here to assist you. Please be advised that you are participating in all activities at your own risk and are fully responsible for yourself, your children and your guests.
Lost and Found
LIFT is not responsible for lost or stolen property. However, we do keep lost and found items whenever possible. Please check with a LIFT coach for the location.
Suggestions/Comments
Your suggestions and concerns are always welcome. Please feel free to contact any of our staff to ask questions as well as make suggestions. A suggestion box is located at each facility. If you have a specific concern which has not been resolved by our membership service staff, you should ask to speak to the Manager(s).
Smoking Policy
LIFT facilities and grounds are smoke-free environments.
Cell Phones & Other Electronics
The use of cell phones will not be permitted in LIFT locker rooms and changing areas. We ask that you put all electronics and cameras away while in changing areas at LIFT.
Individuals with Special Needs
Please contact LIFT about any accommodations needed for participation.
Attire
Appropriate shirts, shorts and footwear is required during exercise in all workout facilities.
Towels
Members should bring their own towels.
Personal Hygiene
Members must maintain proper personal hygiene when attending classes, sessions or other events at LIFT. Clothing and attire should be clean, unsoiled and without rips or tears. Gym shoes should be fully enclosed, clean (no mud or dirt) and without rips or tears. (Working out in sandals or flip flops is not permitted.). As the programming involves movements where members hands, feet and bodies come in contact with LIFT equipment, members themselves should be showered and clean and not have any body odor. Members hair and hands should be clean and free of any dirt, oils or grease that can get transferred to weightlifting equipment.

Terms & Conditions:
All LIFT.Human Group Training memberships, including Discounted memberships are automatically auto-renewed each month on the same terms as the original contract of choice unless changed by the member. Drop Ins, Class Packs, Personal and Semi-Private training are not automatically renewed.
Contract Duration and Automatic Renewal: LIFT.Human Group Training memberships automatically renew unless canceled by the member or LIFT, with notification in writing of 7 days for month to month in advance of the next billing date. If notification is received less than the required 7 days, member will be charged for the next month.
Cancellation Rights: You may cancel your LIFT.Human Group Training or Discounted membership at any time with 7 days advance notice before the next billing cycle. Please send written notice of cancellation to: team@lifttrainingco.com Subject: Cancellation
Injury or Illness: If ever the case of injury or illness occurs, with written note from physician, membership can be put on freeze till date approved to resume fitness program. Dates must be provided on the start and end hold date.
Refunds: We do not issue refunds if you do not use your membership or consume all of your Personal Training , nor can you carry it over to the next month if you missed a class. Contracts are transferable to family and/or friends only with approval by LIFT in advance. Transferees must carry out an initial consultation with LIFT to confirm their eligibility, and must sign all required LIFT membership forms and waivers. Once a membership is transferred it cannot be transferred again. Should LIFT agree to issue a refund, LIFT will recover credit card transaction fees that were charged as part of the initial purchase.
Agreement to Pay Recurring Fees: As a member you agree to pay monthly recurring fees as follows: via Client authorized automatic credit card or checking account ACH charges. Payment in monthly increments by any means other than Client's credit card or ACH is must be reviewed and agreed to by LIFT.
Reservations for Group Classes: Member agrees to employ the LIFT online reservation system/app to create a reservation in advance of every group class they attend. Member acknowledges that LIFT may cancel a group class if there are no reservations in advance.
Reservations for Personal Training: All appointments booked need a 24 hour cancellation notice if you choose to cancel, otherwise the full price of session is charged. All sessions must be used within 90 days of purchase (unless otherwise noted) or will be forfeited. All appointments must be made with your trainer directly and put in the gym reservation system (WODBOARD).
Weather Cancellations: LIFT, at its sole discretion, may decide to cancel a class for reasons of inclement weather. LIFT will make every effort to inform members of impending cancellations.

(a) I agree to purchase the aforementioned membership, as an automatic monthly charge to my payment method.
(b) I hereby certify that I am the holder of the payment method and an authorized signer for same.
(c) I understand that I will be notified if my payment method fails to authorize for any reason, and that a $15 late fee will apply if I do not provide a valid payment method within 10 calendar days of the original rejection date.
(d) I understand that my service will be deactivated if my account becomes more than 15 calendar days late.
(e) LIFT reserves the right to cancel anyone’s membership at any time or any reason.
(f) LIFT DOES NOT SHARE ANY CUSTOMER INFORMATION WITH ANY 3RD PARTIES
Membership Payments will be on the 1st of each month.
