I agree to participate in one or more physical fitness program(s)/class(es) sponsored by FUELL Training, which may include, but not necessarily be limited to CrossFit/Functional Fitness training. FUELL Training made me fully aware that the fitness programs/classes which FUELL Training offers and in which I desire to participate are of a nature and kind that are extremely strenuous and can/may push me to the limits of my physical abilities. I the undersigned recognise and understand that the programs/classes are not without varying degrees of risk which may include, but are not limited to the following:
Injury to the musculoskeletal and/or cardio respiratory systems which can result in serious injury or death, injury or death due to negligence on the part of myself, my training partner, or other people around me, injury or death due to improper use or failure of equipment, or injury or death due to a medical condition, whether known or unknown by me. I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s).
I willingly assume full responsibility for any and all risks that I am exposing myself to as a result of my participation in FUELL Training programs/classes and accept full responsibility for any injury or death that may result from participation in any activity, class or physical fitness program.
I herby certify that I know of no medical problems that would increase my risk of illness and injury as a result of participation in a fitness program designed by FUELL Training. FUELL Training informed me that there exists the possibility of adverse physical changes during an exercise program and I fully understand the same.
FUELL Training informed me that these changes could include abnormal blood pressure, fainting, disorder of heart rhythm, stroke, and in very rare instances, heart attack or even death, and I fully understand the same. With my full understanding of the above information, I agree to assume any and all risk associated with my participation in FUELL Training fitness programs/classes.
RELEASE:
In full consideration of the above mentioned risks and hazards and in full consideration of the fact that I am willingly and voluntarily participating in the activities made available by FUELL Training, and with my full understanding of all of the above, I hereby waive, release, remise and discharge FUELL Training and its agents, officers, principals and employees and volunteers, of any and all liability, claims, demands, actions or rights of action, or damages of any kind related to, arising from, or in any way connected with, my participation in FUELL Training fitness programs/classes, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties.
This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect.
If I am signing on behalf of a minor child , I also give full permission for any person connected with FUELL Training to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the well being of the child.
Indemnification: I recognise that there is risk involved in the types of activities offered by FUELL Training. Therefore I accept financial responsibility for any injury that I or the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless FUELL Training, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by FUELL Training.
Use of picture(s)/film/likeness: I agree to allow FUELL Training, its agents, officers, principals, employees and volunteers the picture(s), film and/or likeness of me for advertising purposes. In the event I choose not to allow the use of the same for said purpose, I agree that I must inform FUELL Training of this in writing.
I have fully read and fully understand the foregoing assumption of risk, and release of liability and I understand that by signing it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission. I understand that by signing/submitting this form I am waiving valuable legal rights.
This policy outlines the terms relating to membership commencement, monthly billing, payment obligations, membership pauses, cancellations and general membership administration. By commencing a membership with the gym, all members agree to the following terms.
1. MEMBERSHIP START DATE & MONTHLY BILLING
All memberships commence from the date of the member’s first successful membership payment.
Membership payments are collected on a recurring monthly basis, with all members billed on the 5th of each month.
Membership remains active and ongoing until either:
- a formal cancellation request has been submitted and completed in line with this policy, or,
- a formal membership pause has been agreed in writing.
2. FAILED PAYMENTS/MISSED DIRECT DEBITS
It is the member’s responsibility to ensure sufficient funds are available for all scheduled membership payments.
If a scheduled payment or direct debit fails:
- the outstanding balance remains payable immediately;
- the gym reserves the right to re-attempt collection of payment;
- access to classes, facilities and member services may be suspended until the outstanding balance has been cleared.
Any repeated failed payments may result in cancellation of membership at management discretion.
The member remains liable for any unpaid membership fees accrued during this period.
3. MEMBERSHIP PRICE CHANGES
The gym reserves the right to amend membership pricing at any time.
Members will be provided with a minimum of 14 days written notice prior to any membership fee increase taking effect.
Continued membership beyond this notice period constitutes acceptance of the revised membership rate.
4. MEMBERSHIP TRANSFERABILITY
All memberships are personal to the named member and are strictly non-transferable.
Memberships may not be shared, transferred, assigned, sold or used by any other individual.
Any breach of this condition may result in immediate suspension or termination of membership.
5. MEMBERSHIP CANCELLATION POLICY
Members may cancel their membership in line with the following policy:
- One Calendar Month Notice Required
- All membership cancellations require a minimum of 1 calendar month written notice.
- Membership remains active throughout this notice period.
- Cancellation Requests Must Be Made Via Email
- All cancellation requests must be submitted in writing via email.
- Cancellation requests will only be deemed valid once written confirmation has been received from the gym.
Final Payment & Pro-Rata Charges:
As all memberships require 1 calendar month notice, a final payment may still be due after cancellation notice has been submitted. Where the cancellation notice period extends beyond the normal monthly billing date of the 5th, the final payment will be charged on a pro-rata basis to cover only the remaining days owed within the notice period. Members remain responsible for all payments due until the cancellation notice period has been completed.
Non-Attendance Does Not Constitute Cancellation:
Failure to attend classes, non-use of the facility, or cancelling direct debit payments does not constitute cancellation of membership. Membership fees remain payable until a formal cancellation request has been submitted and the full 1 calendar month notice period has been fulfilled.
Rejoining After Cancellation:
Any future membership started after cancellation will be subject to current pricing, availability and membership terms at the time of rejoining.
6. MEMBERSHIP PAUSE POLICY
We understand that on occasion members may need to temporarily pause their training. Membership pauses may be requested under the following conditions:
Minimum & Maximum Pause Length
- The minimum membership pause period is 1 calendar month.
- The maximum membership pause period is 3 calendar months.
Memberships cannot remain paused beyond 3 calendar months. If a member does not wish to resume after this period, the standard 1 calendar month cancellation notice period will apply should they choose to cancel their membership.
Restart Date Required:
All pause requests must include a confirmed membership re-start date at the time the request is submitted.
Membership pauses cannot be processed without a clear date for the membership to automatically resume.
Unlimited Pauses Are Not Available:
Membership pauses are intended for occasional circumstances only and are not available on an unlimited, repeated or open-ended basis.
Frequent or excessive pause requests may be declined at management discretion.
How To Request A Membership Pause:
All membership pause requests must be submitted via email.
The email must include:
Full Name
Membership Type
Requested pause start date
Requested membership re-start date
Reason for pause
Important Notes Regarding Membership Pauses:
- Membership payments will only be suspended once the pause has been approved in writing.
- Membership will automatically resume on the agreed re-start date.
- Failure to attend classes or temporary non-use of the facility does not constitute a membership pause.
7. GENERAL MEMBERSHIP ADMINISTRATION
The gym reserves the right to amend membership structures, class timetables, coaching team, operating hours and internal policies where reasonably required for the effective operation of the business. Where any significant changes affect membership terms, reasonable notice will be provided.
8. AGREEMENT TO TERMS
By commencing membership and making the first membership payment, all members acknowledge that they have read, understood and agreed to abide by these Membership Terms & Conditions.
