If purchasing a membership (contract) you agree to monthly payments to be automatically taken from your bank card listed on your GoCardless profile.
If your bank card expires, payments will continue to be taken and your account will show a negative balance. In this situation, full payment must be received before you will be allowed to book future services/classes at CrossFit MTN.
Should you want to cancel your membership, send written confirmation to the following email: info@crossfitmtn.com. This must be received 2 weeks before the end of the month.
No refund will be issued for unused sessions on any membership.

Please Note: Removing your card details or cancelling you mandate does not cancel your membership and may result in debt collection agencies being contacted.

Cancellation Policy

CrossFit MTN enforces a 2-hour cancellation policy due to the high demand for classes.
No refunds will be given if cancellations occur within this 2-hour period and will be classed as late cancels.
Should you want to cancel your membership, send written confirmation to the following email: info@crossfitmtn.com. This must be received 2 weeks before the end of the month.

Refund & Returns policy

We only offer refunds if CrossFit MTN is at fault.
No refunds will be issued for unused sessions or products that have been worn.

CrossFit MTN does not offer to freeze memberships. Memberships can only be canceled as per the cancelation policy. If an individual cancels and rejoins, they will pay the new membership price if it has increased and not offered their old rate.

Personal data you have provided to us when you enquire or become a Member of us or apply for a job with us including name, address, and contact details (including email address and phone number);
The name and contact details (including phone number) of your next of kin;
Details of referrals, quotes, and other contact and correspondence we may have had with you;
Information obtained from customer surveys, promotions, and competitions that you have entered or taken part in;
Recordings of calls we receive or make;
Notes and reports about your health and any treatment and care you have received and/or need, including injury clinic visits, personal training sessions, and class workout scores.
Patient feedback and treatment outcome information you provide;
Entered competitions and promotions that we have run;
Information about complaints and incidents;
Information you give us when you make a payment to us, such as financial or credit card information;
Other information received from other sources, including from your use of websites and other digital platforms we operate or the other services we provide, information from business partners, advertising networks, analytics providers, or information provided by other companies who have obtained your permission to share information about you;
Completed our forms, or otherwise provided information to us, when accessing and/or using the products and services we make available, whether in our club or otherwise; some of that information may be considered sensitive personal data for the purposes of the Act, and we will ask you for your specific written consent for us to use that information before you give that information to us, and we will tell you how we intend to use that information when we ask you for your consent.

Where you have named someone as your next of kin and provided us with personal data about that individual, it is your responsibility to ensure that that individual is aware of and accepts the terms of this Privacy Policy.

Where you use any of our websites, we may automatically collect personal data about you including:

Technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, browser type and version, time zone setting, browser plug-in types and versions, operating system, and platform,
Information about your visit, including the full Uniform Resource Locators (URL), clickstream to, through, and from our site (including date and time), products you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page.

Fitness class booking history
Financial transaction information
CCTV video and images
Visit one of our websites
Enquire about any of our services or treatments
Register to be a customer or patient with us or book to receive any of our services or treatments
Fill in a form or survey for us
Carry out a transaction on our website
Participate in a competition, promotion, or other marketing activity like Social Media posts i.e. Instagram
Make online payments
Contact us, for example by email, telephone, or social media
Participate in interactive features on any of our websites.
In the interests of training and continually improving our services, calls to us and our agents may be monitored or recorded.

Personal data relating to children

We hold data relating to members aged under 16 years old in order to deliver fitness services specifically for children. We collect and process this data with the consent of a parent or holder of parental responsibility.

Information we receive from other sources

If you are an employee or acquaintance of one of our clients who has taken up one of our services, we may be passed your name, contact number, and email address, in order to get in touch with you to arrange an appointment or collect further information from you.

Reasons for collecting that personal data

We collect and store your personal data in order to provide you with membership-related services, such as access to our facilities. The legal basis for processing any personal information as part of this request is processed on the basis of the performance of a contract or taking necessary steps to enter into a contract. Examples include:

Registering you for membership to our club;
Managing your membership account and the products and/or services available to you through it;
Collecting and managing your payment for membership and, if you do not pay, taking such steps as are necessary to arrange for you to make that payment; and
To notify you about changes to our products or services; and

We also have legitimate interests in processing your personal data which include:

To contact members to provide them with information about offers, products, and services through email, SMS, and post.

Who do we share your personal data with:

In the usual course of our business, we may disclose your personal data (to the extent necessary) to certain third-party organizations that we use to support the delivery of our services. This may include the following:

Business partners, suppliers, and sub-contractors for the performance of any contract we enter into with you,
Organizations providing IT systems support and hosting in relation to the IT systems on which your information is stored,
Third-party debt collectors for the purposes of debt collection,
Delivery companies for the purposes of transportation,
Third-party service providers for the purposes of the storage of information and confidential destruction; and
Third-party marketing companies for the purpose of sending marketing emails, subject to obtaining appropriate consent.

Where a third-party data processor is used, we ensure that they operate under contractual restrictions with regard to confidentiality and security, in addition to their obligations under Data Protection Laws.

We may also disclose your personal data to third parties in the event that we sell or buy any business or assets or where we are required by law to do so.

Receiving communications from CrossFit MTN Limited and updating your preferences

If you are an existing customer and have not opted out of receiving marketing communication from us at the time you provided your personal details, we will contact you by email and SMS to inform you of our products and services we think may be of interest to you. You are able to update your marketing contact preferences at any time in the 'contact' section of your profile you use to book sessions etc.

Right to object

You have the right to object to the processing of your personal data in certain circumstances.

There is an absolute right to stop your personal data from being used for direct marketing. If you wish to amend your marketing preferences or prevent your personal data from being used for marketing purposes please either amend it yourself in your profile via our website or send your objection to info@crossfitmtn.com .

Retention of personal data

We do not retain personal data for as long as necessary and we will retain personal data provided to us in line with our retention schedule. Once the period has elapsed, we will securely destroy your personal data in accordance with our data handling policies.

Security of personal data

We take the confidentiality, integrity, and availability of your personal data seriously and have implemented technical and organizational measures to ensure that your information is kept secure. We conduct assessments to ensure the ongoing security of our information systems.

Personal data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Where we transfer your personal data outside the EEA, we will ensure that there are adequate protections in place for your rights, in accordance with Data Protection Laws. By submitting your personal data, and providing any personal data to us, you agree to this transfer, storing, or processing. We will take all steps reasonably necessary to ensure that your information is treated securely and in accordance with this Privacy Policy.

All information you provide to us is stored securely. Any payment transactions on our website will be processed securely by third-party payment processors.

Where we have given you (or where you have chosen) a password that enables you to access certain parts of our website, you are responsible for keeping that password confidential. We ask you not to share a password with anyone.

Right of access

Right for erasure

It is your right to request the deletion of your data from our records, except (as explained above) if it is necessary for us to perform our legal obligations or contractual obligations to you or another third party. In some circumstances, receive the personal data which you have provided to us, in a structured, commonly used, and machine-readable format and have this transmitted to another data controller (Data Portability);

Use of photos on social media for adults and kids:

In agreeing to this policy, members of CrossFit MTN are giving consent for photos to be used by the business for promotional and business use. For members under the age of 16, the parent/guardian/adult signing them up is agreeing to this on their behalf.

If you do not agree to this, then please let a member of staff know and they will ensure your photograph is not used for promotional or business use.

Complain to the ICO

If you have concerns about the way we have handled your personal data please contact us in first instance. If you remain unsatisfied you can contact the ICO at 0303 123 1113, by emailing casework@ico.org.uk

If you are between the ages of 15 and 69, the PAR-Q will tell you if you should check with your doctor before you significantly change your physical activity patterns. If you are over 69 years of age and are not used to being very active, check with your doctor.

Please read each question carefully and answer honestly.

- Has your doctor ever said you have a heart condition and that you should only do physical activity recommended by a doctor?

- Do you feel pain in your chest when you do physical activity?

- Do you lose balance because of dizziness or do you ever lose consciousness?

- Do you have a bone or joint problem (for example back, knee, or hip) that could be made worse by a change in your physical activity?

- Is your doctor currently prescribing medication for your blood pressure or heart condition?

- Do you know of any other reason why you should not take part in physical activity?

If you answered YES to one or more questions:
You should consult with your doctor to clarify that it is safe for you to become physically active at this current time and in your current state of health.

If you answered NO to ALL of the questions:
It is reasonably safe for you to participate in physical activity, gradually building up from your current ability level. A fitness appraisal can help determine your ability levels

TERMS & CONDITIONS:

By agreeing to this, I wish to participate in the exercise and training program offered by CrossFit MTN Ltd.

I understand there are inherent risks in participating in a program of strenuous exercise. Consequently, I have been examined by a physician of my choice and have obtained his/her approval for my participation in a fitness program within sixty (60) days of the date of creating this profile.

No change has occurred in my physical condition since the date such approval was given which might affect my ability to participate in the fitness program. If a physician has not examined me, I agree to see a physician within sixty (60) days of the date this profile was created to obtain his/her approval for my participation in a fitness program.

I agree that CrossFit MTN Ltd shall not be liable or responsible for any injuries to me resulting from my participation in the fitness program (whether at home, at the training studio, outdoors, or at a corporate, commercial, residential, or any another fitness facility) or during any of the other services we offer. I expressly release and discharge CrossFit MTN Ltd. and its owners, employees, agents, and/or assigns, from all claims, actions, judgments, and the like which I or my heirs, executors, administrators, or assigns may have or claim to have as a result of any injury or other damage which may occur in connection with my participation in the fitness program, excepting only an injury caused by the gross negligence or intentional act of such person or persons.

This Release shall be binding upon my heirs, executors, administrators, and assigns.

I understand that I am not obligated to perform nor participate in any activity that I do not wish to do and that it is my right to refuse such participation at any time during my training sessions.

I understand that should I feel light-headed, faint, dizzy, nauseated, or experience pain or discomfort, I am to stop the activity and inform my Trainer.

I understand the results of any fitness program cannot be guaranteed and my progress depends on my effort and cooperation in and outside of the sessions.

I understand that during a training session, my trainer may have to use Touch Training to correct alignment and/or to focus my concentration on a particular muscle area to be targeted. If I feel uncomfortable or experience any type of discomfort with Touch Training, I will immediately request that my trainer discontinue using this technique.

I understand that the usage of any nutritional supplements is done under my own will.

I understand that CrossFit MTN Ltd. may photograph and/or film their client events/sessions and I agree to allow them to use these pictures, films, and/or likenesses of me for promotional purposes.

In the event I choose not to allow the use of the same for said purpose, I agree that I must inform CrossFit MTN Ltd.. of this in writing (this is not applicable for CrossFit Kids and CrossFit Teens without prior consent by the Parent or Legal Guardian).

If you are a parent or the legal Guardian of a child taking part in the CrossFit Kids and/or CrossFit Teens training session at CrossFit MTN, you will be agreeing to the information in this liability waiver on behalf of the child taking part.

I have read the statements of this legal document, understood the statements of this legal document, and agree with its terms and conditions.

I understand that this document is complete unto itself and that any oral promises or representations made to me concerning this document and/or its terms and conditions are not binding upon CrossFit MTN Ltd. its officers, agents, and/or employees.

I have voluntarily agreed to it and execute it voluntarily with full knowledge of its meaning, significance, and Implications.
