GYM WAIVER AND RELEASE OF LIABILITY
This Gym Waiver and Release of Liability (the "Waiver") is entered into between the undersigned participant ("Participant") and CrossFit Paratus (the "Gym").
1. Assumption of Risk
I understand that the activities I will engage in during gym hours at CrossFit Paratus involve inherent risks, including but not limited to the risk of injury, illness, and the potential for serious bodily harm. I acknowledge that I am voluntarily participating in these activities with knowledge of the dangers involved and hereby agree to accept and assume any and all risks associated with my participation.
2. Release and Waiver
In consideration for being permitted to use the facilities and equipment at CrossFit Paratus during gym hours, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, discharge, and hold harmless CrossFit Paratus, its owners, operators, employees, agents, and representatives from any and all claims, liabilities, actions, damages, costs, or expenses of any kind arising out of or related to my use of the gym facilities, except where liability cannot be excluded under applicable law.
3. Responsibility for Personal Safety
I acknowledge that open gym hours are not coach-led, and I am solely responsible for my personal safety. I agree to exercise caution, follow all posted rules and guidelines, and use equipment properly. I understand that failure to do so may increase the risk of injury.
During coach-led sessions I agree to:
• follow coach instruction and gym rules
• use equipment respectfully and safely
• behave in a manner that protects the safety and experience of other members
CrossFit Paratus reserves the right to suspend or terminate access for unsafe or inappropriate behaviour.
4. Maintenance of Cleanliness
I agree to keep the gym tidy, put away equipment after use, and ensure that the gym is left in a clean and orderly state. I understand that failure to maintain cleanliness may result in restricted access or additional charges for cleaning expenses. I agree to report any damaged equipment immediately to Management. Failure to comply may result in restricted access or charges.
5. Medical Clearance
I affirm that I am in good physical condition and have no medical or health-related conditions that would prevent or limit my participation in the activities at CrossFit Paratus. I understand that it is my responsibility to obtain medical clearance from a qualified healthcare professional if I have any concerns about my ability to engage in physical activities.
6. Emergency Medical Treatment
In the event of an injury or medical emergency, I authorize CrossFit Paratus and its representatives to seek and obtain necessary medical treatment on my behalf. I understand that I will be responsible for any medical expenses incurred.
7. Membership Cancellation Notice
7.1 Members wishing to cancel their membership must provide a minimum of thirty (30) days written notice to CrossFit Paratus.
Membership fees will remain payable during the notice period. Access to the gym will continue until the end of the notice period unless otherwise agreed in writing.
7.2 Intro Course Auto-Enrolment - Participants enrolled in an introductory course will be automatically enrolled into an ongoing membership upon completion of the course.
If the Participant does not wish to continue into membership, they must provide a minimum of seven (7) days written notice prior to the final session of the introductory course.
Where notice is not received within this timeframe, membership will commence automatically and standard membership terms, including the cancellation notice period, will apply.
8. Membership Pause Policy
Membership pauses may be requested by providing a minimum of seven (7) days written notice prior to the intended pause start date.
Membership pauses:
• may be granted for a maximum continuous period of three (3) months
• must have a defined start and end date
• cannot be backdated
• may be refused where accounts are in arrears
Billing will be adjusted in accordance with the Gym’s membership policy.
9. Media & Photography Consent
I acknowledge that photos/videos may be taken for coaching, marketing, and community purposes. I may withdraw consent in writing at any time.
10. Dogs & Facility Safety
Dogs may only be brought into the facility with prior permission and must remain controlled at all times to protect members and children.
11. Termination by the Gym
CrossFit Paratus may suspend or terminate membership where safety, conduct, or payment obligations are breached.
12. Governing Law
This Waiver shall be governed by and construed in accordance with the laws of England and Wales. Any legal action or proceeding arising out of or related to this Waiver shall be venued in the courts of England and Wales.
