Express assumption of risk:
I, the undersigned, am aware that there are significant risks involved in all aspects of physical training. These risks include, but are not limited to:
•Injury to the musculoskeletal and/or cardiorespiratory system which can result in serious injury or death.
•Injury or death due to negligence on the part of myself, my training partner, or other people around me.
•Injury or death due to improper use or failure of equipment.
•Injury or death due to a medical condition, whether known or unknown to me.
I am aware that any of the above mentioned risks may result in serious injury to myself and/or my training partner(s).
I willingly assume full responsibility for the risks I am exposing myself to and accept full responsibility for any injury or death that may result from participation in any activity or class which at CrossFit TwentyThree. I, the undersigned, acknowledge that I have no physical impairments or illnesses that will endanger myself or others. I, the undersigned, will bring to the attention of CrossFit TwentyThree, any physical impairments or illnesses that may endanger myself or others by accurately completing the question below.
Release of liability:
In consideration of the above-mentioned risks and hazards and in consideration of the fact that I am willingly and voluntarily participating in the activities available at CrossFit TwentyThree, I, the undersigned, hereby release CrossFit TwentyThree, their principals, agents, employees and volunteers, from any and all liability, claims, demands, actions or rights of action which are related to, arise out of, or are in any way connected with my participation in this activity, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties.
This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect.
If I am signing on behalf of a minor (a child under the age of 18), I also give my permission for any person connected with CrossFit TwentyThree to administer First Aid deemed necessary, and in the case of serious illness or injury, I give permission to call for medical and/or surgical care for the child and to transport the child to a medical facility deemed necessary for the well-being of the child.
Release of Liability for Mezzanine and Balcony:
In addition to the aforementioned risks and hazards, I specifically acknowledge and assume the risks associated with the mezzanine and balcony at CrossFit TwentyThree, including but not limited to:
- Falling from the balcony due to accidental or intentional actions.
- Injury from objects falling from the balcony or mezzanine.
- Any other hazards associated with elevated areas.
I understand that by voluntarily using the mezzanine and balcony, I release CrossFit TwentyThree, their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions, or rights of action related to, arising out of, or in any way connected with my use of the mezzanine and balcony, including those allegedly attributed to the negligent acts or omissions of the aforementioned parties.
Open Gym:
I acknowledge that during open gym sessions at CrossFit TwentyThree, there will be no supervision or instruction provided. I understand that using the gym and its equipment during these unsupervised sessions is entirely at my own risk. The risks include, but are not limited to:
- Injury due to improper use of equipment.
- Injury due to lack of supervision or guidance.
- Injury resulting from other participants' actions or negligence.
I accept full responsibility for any injury or harm that may occur to me during open gym sessions and release CrossFit TwentyThree, their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions, or rights of action related to, arising out of, or in any way connected with my participation in open gym sessions, including those allegedly attributed to the negligent acts or omissions of the aforementioned parties.
Indemnification:
The participant recognises that there is a risk involved in the types of activities offered by CrossFit TwentyThree. Therefore the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above-mentioned parties, or anyone acting on their behalf, be required to incur legal fees and costs to enforce this agreement, the participant agrees to reimburse them for such fees and costs. The participant further agrees to indemnify and hold harmless CrossFit TwentyThree, their principals, agents, employees and volunteers from liability for the injury or death of any person(s) and/or damage to property that may result from the participants negligent or intentional act or omission while participating in activities offered by CrossFit TwentyThree.
I have read and understood the foregoing assumption of risk and the release of liability, and I understand that by signing it obligates me to indemnify the parties named for any liability for injury or death of any person and/or damage to property caused by my negligent or intentional act or omission. I understand that by signing this form I am waiving valuable legal rights.
Declaration:
I agree to allow CrossFit TwentyThree, its employees and volunteers to use picture(s), film and/or likeness of me for advertising purposes. In the event I choose not to allow use of such media I must inform CrossFit TwentyThree of this in writing.
I have fully read and understand the foregoing assumptions of risk and release of liability, and I understand that by signing below it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission. I understand that by signing this form I am waiving valuable legal rights.
