I agree to participate in one or more physical fitness program(s)/class(es) sponsored by 3M Fitness. 3M Fitness made me fully aware that the fitness programs/classes which 3M Fitness offers and in which I desire to participate are of a nature and kind that are extremely strenuous and can/may push me to the limits of my physical abilities. I the undersigned recognize and understand that the programs/classes are not without varying degrees of risk which may include, but are not limited to the following:

Injury to the musculoskeletal and/or cardio respiratory systems which can result in serious injury or death, injury or death due to negligence on the part of myself, my training partner, or other people around me, injury or death due to improper use or failure of equipment, or injury or death due to a medical condition, whether known or unknown by me. I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s).

I willingly assume full responsibility for any and all risks that I am exposing myself to as a result of my participation in 3M Fitness programs/classes and accept full responsibility for any injury or death that may result from participation in any activity, class or physical fitness program. I hereby certify that I know of no medical problems that would increase my risk of illness and injury as a result of participation in a fitness program designed by 3M Fitness. 3M Fitness informed me that there exists the possibility of adverse physical changes during an exercise program, and I fully understand the same. 3M Fitness informed me that these changes could include abnormal blood pressure, fainting, disorder of heart rhythm, stroke, and in very rare instances, heart attack or even death, and I fully understand the same. With my full understanding of the above information, I agree to assume any and all risk associated with my participation in 3M Fitness programs/classes.

In full consideration of the above mentioned risks and hazards and in full consideration of the fact that I am willingly and voluntarily participating in the activities made available by 3M Fitness, and with my full understanding of all of the above, I hereby waive, release, remise and discharge 3M Fitness and its agents, officers, principals and employees and volunteers, of any and all liability, claims, demands, actions or rights of action, or damages of any kind related to, arising from, or in any way connected with, my participation in 3M fitness programs/classes, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties.

This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect.

Indemnification:
I recognise that there is risk involved in the types of activities offered by 3M Fitness. Therefore I accept financial responsibility for any injury that I or the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above mentioned parties, or anyone acting on their behalf, be required to incur legal fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless 3M Fitness, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by 3M Fitness.

Use of picture(s)/film/likeness:
I agree to allow 3M Fitness, its agents, officers, principals, employees and volunteers the a picture(s), film and/or likeness of me for advertising purposes. In the event I choose not to allow the use of the same for said purpose, I agree that I must inform 3M Fitness of this in writing.

I have fully read and fully understand the foregoing assumption of risk, and release of liability and I understand that by signing it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission. I understand that by signing this form I am waiving valuable legal rights.

Membership Terms

1.1. The term of this Agreement shall commence on the Effective Date and shall continue, unless terminated earlier in accordance with the terms herein.

1.2. Following the Initial Term, this Agreement shall automatically renew on a month-to-month basis unless either party provides written notice of termination at least 4 weeks prior to the end of the then-current term.

2. Membership Rights and Privileges

2.1. Subject to the terms and conditions of this Agreement, the 3M Fitness grants the Member the right to access and use the Gym facilities during regular operating hours.

2.2. The Member shall have access to all equipment, amenities, and classes offered by the 3M Fitness, subject to availability and any additional fees or requirements.

3. Membership Fees

3.1. In consideration for the membership rights and privileges granted herein, the Member shall pay 3M Fitness a monthly membership fee, as opted in. Payment shall be made in advance on a monthly basis.

3.2. 3M Fitness reserves the right to adjust the membership fee upon providing the Member with 4 weeks written notice of any such changes.

4. Payment and Billing

4.1. Membership fees shall be paid by the Member through Stripe. The Member hereby authorizes 3M Fitness to automatically charge the designated payment method for the membership fees on a recurring basis.

4.2. In the event of a declined payment, 3M Fitness may suspend the Member's access to the facilities until payment is successfully processed.

5. Membership Cancellation and Termination

5.1. The Member may cancel this Agreement at any time by providing written notice to 3M Fitness. Such cancellation shall be effective 4 weeks following receipt of the notice.

5.2. 3M Fitness may terminate this Agreement immediately upon written notice to the Member for any material breach of the terms herein, including failure to pay membership fees or violation of 3M Fitness rules and regulations.

6. Waiver and Release

6.1. The Member acknowledges and understands the risks associated with physical exercise and use of 3M Fitness facilities and hereby releases and waives any claims against the Gym for personal injury, property damage, or any other loss arising from or related to the use of 3M Fitness facilities.

7. Miscellaneous

7.1. This Agreement constitutes the entire understanding between the parties concerning the subject matter hereof and supersedes all prior agreements and understandings, whether written or oral.

7.2. This Agreement may be amended or modified only in writing and signed by both parties.

8. Governing Law

8.1. This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising under or in connection with this Agreement shall be resolved exclusively in the courts of England and Wales.

As part of our commitment to maintaining a safe and secure environment for our members, staff, and visitors, 3M Fitness uses closed-circuit television (CCTV) at our premises.

Purpose of Collection:

To protect the safety and wellbeing of individuals on the premises

To prevent and detect crime, theft, or vandalism

To support the resolution of incidents and complaints

To monitor compliance with facility rules and safety policies

Location of Cameras:
Cameras are located in public/common areas such as entrances, training floor, coffee bar/social spaces, and parking area. Cameras are not installed in private areas such as bathrooms or changing rooms.

Legal Basis for Processing:

Under the UK GDPR: Legitimate interests (Article 6(1)(f))

Retention of Footage:
Footage is stored securely and retained for a maximum of 30 days, unless required longer due to an active investigation.

Access and Disclosure:
Footage is only accessible to authorised staff and may be disclosed to law enforcement if required by law.
