Informed Consent

I am aware that there are significant risks involved in all aspects of physical training. I understand that the reaction of the heart, lungs, and vascular system to exercise cannot always be predicted with accuracy. I understand that there is a risk of certain abnormal changes occurring during or following exercise which may include abnormalities of blood pressure or heart rate; chest, arm or leg discomfort; transient light-headedness or fainting; and, in rare instances, heart attack, stroke, or even death.

Excessive work can result (in rare cases) in exertional rhabdomyolysis. I understand that I should look for signs of excessive soreness, darkened urine, and pain in the kidney areas in the days following a particularly intense workout. I understand that this type of injury is relatively rare but may occur due to factors including, but not limited to, genetic predisposition or dehydration, beyond the control of my trainer.

I understand that programmes and classes offered by Mana Performance may be extremely strenuous and may push me to the limits of my physical abilities. These risks include but are not limited to: falls leading to serious injury or death; injury or death due to negligence by myself, my training partner, or others; and injury or death due to improper use or failure of equipment. I acknowledge that any of these risks may result in serious injury or death to myself or my partner(s).

I agree to follow all safety instructions and exercise within my own limits. Failure to follow the instructions of Mana Performance staff may increase the risk of injury.

Par-Q & Informed Consent / Waiver

I willingly assume full responsibility for any and all risks that I am exposing myself to as a result of participation in Mana Performance programmes/classes and accept full responsibility for any injury or death that may result. I certify that I know of no medical problems that would increase my risk of illness or injury as a participant.

By signing this document, I acknowledge that I have voluntarily chosen to participate in a programme of progressive, physical exercise. I understand the strenuous nature of the programme and the potential for unusual, but possible, physiological responses including: abnormal blood pressure, rhabdomyolysis, fainting, heart attack, or death. I assume all risk for my health and well-being and hold Mana Performance, its owners, employees, and authorised agents harmless.

Waiver & Release

I fully understand that my exercise programme may be strenuous and I choose to participate voluntarily. I accept all responsibility for my health and any results, injuries, or mishaps that may affect my well-being in any way. I waive any claims, demands, or causes of action against Mana Performance (including its owners, employees, and agents) arising from participation in any activity.

I agree to use all equipment safely and only as instructed. Mana Performance is not responsible for injury resulting from misuse or failure to follow instructions.

Photo & Video Release

I grant Mana Performance permission to use my photograph or video image in any publications, including website entries, without payment or other consideration. I authorise Mana Performance to edit, alter, copy, exhibit, publish, or distribute these images. I waive my right to inspect or approve the finished product and waive any right to royalties or compensation.

Indemnification

I recognise the risk involved in activities offered by Mana Performance and accept financial responsibility for any injury I may cause to myself or others due to my negligence. If Mana Performance incurs solicitor’s fees to enforce this agreement, I agree to reimburse them. I agree to indemnify and hold harmless Mana Performance and its agents from liability for injury, death, or property damage resulting from my acts or omissions.

COVID-19 Acknowledgement

I understand that despite precautions taken by Mana Performance, exposure to COVID-19 is possible. By entering the facility, I voluntarily assume all risks associated with such exposure and release Mana Performance and its agents from any related liability.

Data Protection Consent

I consent to Mana Performance collecting, storing, and processing my personal information, including health information and images, in accordance with the Data Protection Act 2018 and UK GDPR. My data will be used for programme administration, safety, and marketing purposes, and I may withdraw consent at any time.

Governing Law

This agreement shall be governed by and construed in accordance with the laws of Northern Ireland, and the parties submit to the exclusive jurisdiction of the courts of Northern Ireland.

Insurance Statement

Mana Performance holds appropriate public liability insurance to cover participation in its programmes and activities.
