1. Membership Terms
a. Membership Duration: Memberships are available on a monthly or yearly basis depending on which you selected.
b. Renewal and Cancellation: Memberships automatically renew unless cancelled before the renewal date. Cancellation requests must be submitted in writing one month before the renewal date.
c. Termination: Apex Fitness LDN reserves the right to terminate a membership for violation of gym rules or unacceptable behavior.
d. The Legacy Membership rate is valid for two years, before increasing to the Full Membership rate in Year 3.
e. Membership rates may be subject to change annually dependent on consumer price indexation. Advanced notice will be given where any changes are made.
2. Facility Usage
a. Access Hours: The facility is open weekdays from 6:15am to 7:30pm, Saturdays 9am to 11:30am and Sundays 10am to 12pm.
b. Facility Rules: Members must adhere to facility rules, including safe and proper equipment usage, maintaining cleanliness, and respectful behaviour towards others.
c. Booking: Members must book in before attending the facility. Classes and Open Gym sessions can both be booked via the app.
3. Payment Terms
a. Payment Schedule: Monthly payments are due on the 1st day of the month. Yearly payments are due on the anniversary of the membership start date.
b. Late Fees: A late fee of £25 will be charged for payments received 14 days after the due date.
4. Health and Safety
a. Health Conditions: Members must disclose any health conditions that may affect their ability to participate in exercise activities.
b. Liability Waiver: Members must sign the Apex Fitness LDN waiver releasing the gym from liability for injuries sustained at the facility.
c. Code of Conduct: Members are expected to conduct themselves in a manner that promotes a positive and inclusive gym environment.
5. Membership Freeze or Transfer
a. Freeze Policy: Members may freeze their membership for a minimum of 1 month and a maximum of three months under certain circumstances (e.g., medical reasons or injury).
b. For exceptional circumstances (e.g. extended travel), memberships can be frozen for a minimum of one month with a £50 per month charge.
c. Transferability: Memberships are non-transferable.
6. Equipment Usage
a. Equipment Guidelines: Members must follow proper equipment usage guidelines as provided by gym coaches.
b. Maintenance: Members are responsible for reporting damaged equipment promptly.
7. Events and Promotions
a. Events: The gym may host events or competitions that could affect regular operations. Advance notice will be provided.
b. Promotions: Special promotions or discounts may be offered periodically.
8. Privacy and Data
a. Data Collection: The gym collects personal information for membership purposes only.
b. Privacy Policy: Refer to the gym's privacy policy for details on data handling.
9. Dispute Resolution
a. Arbitration: Any disputes arising from this agreement will be resolved through binding arbitration in accordance with UK law.
10. Amendments to Terms
a. The gym reserves the right to amend terms with prior notice to members.
11. Governing Law
a. This agreement is governed by the laws of England & Wales.
