Storm NRG Waiver and Release of Liability

This Waiver and Release of Liability (the “Agreement”) is entered into by and between Storm NRG, located at Unit 8 Swatragh business park BT46 5QE, and the undersigned member (the “Member”) on the date set forth below.

1. Acknowledgment of Risks:
I, the undersigned, acknowledge that participating in fitness activities and using the facilities and equipment at Storm NRG may involve inherent risks, including but not limited to physical injury, illness, or even death. I understand that the gym facilities and equipment carry potential hazards and that I am responsible for my own safety while engaging in any activity at the gym.

2. Medical Clearance:
I affirm that I am in good physical health and have no medical conditions or impairments that would preclude me from engaging in physical exercise. I agree to consult with a medical professional before beginning any fitness program if I have any concerns about my health.

3. Assumption of Risk:
I voluntarily assume all risks associated with my participation in gym activities, including exercise, weightlifting, use of equipment, classes, and other activities offered by Storm NRG. I understand that accidents or injuries may occur, including those arising from my own actions or the actions of others, and I accept full responsibility for these risks.

4. Release and Waiver:
In consideration of being permitted to use the gym facilities, I hereby release and discharge Storm NRG, its owners, employees, agents, and representatives from any and all claims, demands, or causes of action that I may have, now or in the future, for personal injury, death, or property damage arising out of or in connection with my participation in gym activities, regardless of whether such injury or damage results from the negligence of Storm NRG or any other cause.

5. Indemnification:
I agree to indemnify and hold harmless Storm NRG, its owners, employees, agents, and representatives from any and all claims, losses, or damages, including attorney’s fees, arising out of my use of the gym facilities and participation in activities, whether caused by my own actions, the actions of others, or the condition of the premises.

6. Emergency Medical Treatment:
In the event of an emergency, I consent to any medical treatment deemed necessary by medical professionals to address any injuries or health issues that may arise during my participation in gym activities. I agree to bear all costs associated with such treatment.

7. Photography and Video Release:
I consent to Storm NRG using photographs, video recordings, or other media that may include my image or likeness for marketing, promotional, or educational purposes. I waive any right to inspect or approve the finished images or recordings.

8. Governing Law:
This Agreement shall be governed by the laws of the state or country in which Storm NRG is located, without regard to its conflict of laws principles.

9. Severability:
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10. Acknowledgment and Signature:
By signing below, I acknowledge that I have read and understood this waiver and release of liability, and I voluntarily agree to its terms. I also acknowledge that this Agreement covers my participation in all gym activities, whether now or in the future.

1. Membership Agreement
By signing up for a membership at Storm NRG, you agree to the terms and conditions outlined in this agreement.

2. Payment and Billing
Membership fees are due on a monthly basis. The payment will be automatically charged to the credit card or payment method you provided at the time of registration. Fees are non-refundable once processed for the current billing cycle.

3. Cancellation Policy
• General Cancellation: You may cancel your membership at any time by providing written notice of 14 days before the next month. However, cancellation will take effect at the end of the current billing cycle.
• Cancellation Notice Period: If you wish to cancel your membership, you must submit your cancellation request at least two weeks before the start of the next billing cycle. If the cancellation request is made within the two-week period prior to the next month’s billing date, the membership will automatically renew, and no cancellation will be processed until the following month.
• No Refunds: No refunds will be issued for payments made for the current or previous billing periods.

• There will be financial penalties for those who book a class and don’t show up and also those who cancel within an hour of the class.
4. Access and Use of Facilities
• Your membership grants you access to Storm NRG’s facilities during business hours, subject to the gym’s rules and regulations.
• You agree to follow all gym policies, including conduct, and equipment usage.

5. Health and Safety
You acknowledge that participation in physical activities carries inherent risks, and you assume full responsibility for your health and safety while using the gym’s facilities. Please consult a healthcare provider before starting any new exercise program.

6. Changes to Membership Terms
Storm NRG reserves the right to modify membership fees, terms, and policies with prior notice. Any changes will be communicated via email or posted in the gym.
