These terms and conditions (the "Terms") govern your membership with Infinite Gym. Please read them carefully, as they outline your and our legal rights and responsibilities and contain important information regarding our contract with you.

If you have any questions, feel free to reach out to us before confirming your membership by contacting us at hello@infinitegym.co.uk. By completing the sign-up process, you acknowledge and accept these Terms. If you do not agree to these Terms, do not complete the sign-up process or use our services in any way. Your continued use of our gym facilities indicates your acceptance of these Terms.

References to "we," "our," or "us" refer to Infinite Gym. References to "you" or "your" refer to the member.

1. ABOUT US

We are Infinite Gym, a functional fitness gym registered in Scotland. Our registered office is Unit A4, Midlothian Innovation Centre, Roslin, EH25 9RE. For any questions regarding your membership, please get in touch with us through our email hello@infinitegym.co.uk.

2. DEFINITIONS

2.1 The following definitions apply to these Terms:

**Gym**: Infinite Gym, where you sign up as a member.

**Direct Debit**: The payment arrangement with your bank to pay your monthly fees through Stripe, our payment processing partner.

**Fixed Member**: A member who commits to a fixed-term membership, either 1 or 12 months.

**Package Member**: A member with a class pass or class pass bundle purchase.

**Fixed Member Period**: Your fixed-term membership duration (1 or 12 months).

**Health Declaration**: The declaration regarding your health and fitness status that you complete during sign-up.

**Member**: Refers to both Package Members and Fixed Members.

**Promotional Code**: Any promotional or introductory discount applied to your membership.

**Rules**: The gym's rules, which are displayed at Infinite Gym and on the Infinite Gym website.

3. JOINING

3.1 You can sign up for membership online with our booking system, WodBoard. Please ensure that all details you provide are accurate and complete.

3.2 During sign-up, you must choose between becoming a Package (Drop-in or Bundle) or a Monthly Member. Your contract with us ("Contract") is formed once you pay for your first package or your first month and apply any applicable Promotional Code.

3.3 You must confirm that you are at least 16 years old and agree to abide by the Rules and Health Declaration. We reserve the right to amend the Rules at any time, with updates posted online and in our Gym.

3.4 After completing the sign-up process, your membership begins immediately unless you choose a specific start date.

3.5 You must ensure that all information provided at sign-up and in your Health Declaration is true and correct. We reserve the right to refuse or cancel your membership if we reasonably believe the information provided is false or incorrect.

4. PAYMENT

4.1 If you are a Package Member, you agree to pay an upfront fee for your chosen package. This does not commit you to any rolling contract.

4.2 If you are a Fixed Member, you agree to pay the first Monthly Fee upfront, followed by a rolling monthly payment for 12 months.

4.3 Promotional Codes must be applied during sign-up. After the promotional period ends, we will charge the standard Monthly Fee throughout your contract.

4.4 We will continue to charge Monthly Fees even if you do not use the gym or if access is restricted, except in emergency closures, where we will provide notice.

4.5 If you received a discount via a Promotional Code, your Monthly Fee will revert to the standard rate once the promotional period ends.

4.6 If payment of any amount due is not made by the due date, you will not be permitted to attend classes or access the gym. For every 24 hours that passes thereafter without payment, access will remain restricted, and a late fee of £5 will be added for each 24-hour period. If the outstanding amount is not settled within 30 days, the debt may be passed to a debt collection agency for recovery.

4.7 We reserve the right to increase membership fees at any time after your Fixed Member Period ends. Any renewal or new membership purchased after the completion of your Fixed Member Period will be charged at the then current rate, and the previous membership price will no longer apply.

5. GYM CLOSURES AND CLASS CANCELLATION

5.1 If the gym must close for an extended period, we may freeze your membership and payments during the closure.

5.2 The gym reserves the right to cancel classes or open gym without prior notice. Please note that cancellations will not entitle you to any refunds or credits.

5.3 We require a minimum of 12 hours' notice for any class cancellations. If you cancel a class with more than 12 hours' notice, your class credit will be returned to your account. Cancellations made within 12 hours of the scheduled class time are considered late cancellations, and no credit or refund will be issued. This policy allows us to manage class capacity effectively and offer available spots to other members.

6. CANCELLATION PERIOD

6.1 You have the right to cancel your package, one or 12-month membership if you have yet to book or attend a class within 24 hours of signing up without giving a reason. To cancel, contact us via the Infinite Gym Contact Form or hello@infinitegym.co.uk before the 24-hour period ends.

6.2 If you cancel within this period, we will refund your payment, and your gym and class access will end immediately. Your refund can take up to 30 days to be processed.

6.3 After this period, you may only request to cancel your membership under the conditions described in section 7.

7. CONTRACT TERMINATION OR MEMBERSHIP FREEZE

7.1 Contract Termination
After the 24-hour cancellation window, Fixed Members may request early termination under the following conditions:

Relocation: Moving over 50 miles from Infinite, with supporting documentation (e.g., recent utility bill or bank statement).

Early Exit Fee: Members who do not meet the above criteria may still cancel by paying an early termination fee equal to three months’ membership.

All termination requests must be submitted in writing to hello@infinitegym.co.uk.

Once your request has been approved, you will be informed of your final membership payment date. If your request is approved less than 30 days before your next scheduled payment, you will be required to make that payment in addition to the three-month membership termination fee. If making another monthly payment, you will have access for that month only. If providing more than 30 days’ notice, you will only have access during your last payment period. Your termination of membership is not final until your termination payment has been arranged and paid.

Infinite Gym reserves the right to review and deny any request at its discretion.

7.2 Membership Freeze

Fixed Members may request to freeze their membership in the following circumstances:

Medical Grounds
Long-term illness or injury lasting three months or more, supported by a valid medical note.

Pregnancy
With an appropriate medical note.

All freeze requests must be submitted in writing to hello@infinitegym.co.uk.

Memberships can be frozen for a maximum period of up to 12 months. At the end of the freeze period, the membership will automatically resume for the remaining duration of the original 12-month fixed term from the point at which it was paused.

Alternatively, at the end of the freeze period, the member may choose to terminate their membership by paying a termination fee equivalent to three months’ membership.

Infinite Gym reserves the right to review and deny any request at its discretion.

7.3 End of Fixed Membership Period

At the end of your Fixed Membership Period, your membership will end automatically unless you choose to renew. To renew, you must purchase a new membership before the end of your Fixed Membership Period. If you do not wish to renew, no action is required, and your access to the gym will end at the conclusion of your Fixed Membership Period.

8. CONTRACT TERMINATION BY US

8.1 We may terminate your membership immediately if you:

- Breach any of the Rules.

- Provide false or outdated information in your Health Declaration.

- Engage in behaviour deemed inappropriate by our staff and coaches.

- Share your membership with others.

8.2 We reserve the right to cancel your membership or deny you access to Infinite Gym at any time, with or without prior notice or explanation.

9. QUERIES, PROBLEMS, OR COMPLAINTS

9.1 For queries about Infinite Gym, contact us via our email at hello@infinitegym.co.uk or speak to the staff at Infinite Gym.

9.2 These Terms do not override or exclude any of your legal rights.

10. LIMITS OF OUR RESPONSIBILITY

We are not responsible for:

- Loss or damage that is not reasonably foreseeable.

- Loss resulting from your misuse of the gym or its equipment.

- Loss due to events beyond our reasonable control.

However, nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any situation where liability cannot be legally excluded.

11. YOUR PERSONAL INFORMATION

11.1 We may collect information about you during sign-up and your use of the gym. This is detailed in our Privacy Policy, which forms part of these Terms.

11.2 For Direct Debit purposes, your information may be processed by our payment provider.

11.3 We do not sell your information, but may share it with select third parties.

12. MEDIA CONSENT AND CCTV NOTICE

By attending classes and using the space at Infinite Gym, you acknowledge and consent to the following:

12.1 Media Capture: Infinite Gym may capture photographs and videos of the gym and its activities, including its members, for promotional and marketing purposes. This may include, but is not limited to, social media, website content, and promotional materials. By using the gym facilities, you grant Infinite Gym permission to use such media in any manner, including but not limited to publication, display, or online sharing, without any further notice or compensation to you.

12.2 CCTV Surveillance: For the safety and security of all members, coaches, and employees, Infinite Gym utilises closed-circuit television (CCTV) surveillance throughout its premises. CCTV footage is monitored and recorded to ensure a safe environment and to help resolve any incidents or disputes that may arise. By entering the gym, you consent to being recorded by these surveillance systems.

13. Data Protection & GDPR

By visiting our website, you agree to the use of your data entered for membership purposes. We will not share or sell your data to third-party sites.

We use Squarespace to host our website and scheduler, which includes their privacy and GDPR policy.

14. HOLIDAY & GYM CLOSURES

14.1 Infinite Gym reserves the right to close the gym at any time, with or without prior notice, for operational, maintenance, or safety reasons.

14.2 The gym will generally be closed on public holidays. However, we may offer a limited schedule or additional classes during these times at our discretion.

14.3 Membership fees will not be adjusted or refunded due to temporary closures, including for public holidays or unforeseen circumstances.

Your Behaviour in the Gym:

Respectful Conduct: Please behave safely and respectfully to ensure your own safety and that of others. Be mindful of other members and coaches at all times.

Appropriate Attire: Appropriate gym attire is required at all times. This includes no bare feet, tied shoelaces, and caution when lifting in socks. Outdoor shoes are not allowed in the gym; please change in the provided changing rooms or before class/exercise.

Equipment Use: Handle weights carefully to prevent injury, damage, or disturbance to other members. Always replace weights and equipment to their original position after use.

Safe Use of Equipment: If you are unsure how to use any equipment, seek instruction before use. Infinite Gym is not responsible for injuries resulting from improper equipment use.

Cleanliness and Hygiene: Wipe down equipment or any area you’ve used after your session for hygiene reasons.

Faulty Equipment: Report any faulty or malfunctioning equipment to staff immediately.

Abuse and Harassment:

We have a zero-tolerance policy for harassment or abuse directed towards our coaches, members, or staff. Respect is essential at all times.

Intimidating, abusive, violent, or disrespectful behaviour may result in immediate ejection from the gym and termination of membership without a refund.

Discriminatory conduct, including racist, sexist, homophobic, transphobic, or ableist behaviour, will not be tolerated. Any incidents should be reported immediately to hello@infinitegym.co.uk.

Personal Items and Valuables:

Infinite Gym is not responsible for the safety of personal items. We do not provide storage for personal belongings.

Locking the Gym: While the front door has a lock, it is the member's responsibility to ensure it is securely locked when entering and exiting the gym.

Gym Communal Property:

Gym property, such as toilet paper, towels, and toiletries, is provided for use during your visit only. Removal of any gym property may lead to termination of membership privileges and legal action.

Use of Smartphones:

Videography and Photography: Videography and photography are not allowed in changing rooms.

When using your smartphone or device, keep it secure and on your person rather than leaving it on gym equipment.

Respect Privacy: Respect others' privacy by obtaining consent from anyone who appears in photos or videos you take. If consent is withheld, delete the images or footage. If you share publicly, explain the purpose of the content and obtain consent.

If you prefer not to have your image used in any filming or photography by Infinite Gym, please inform a staff member.

Classes:

Booking: Book classes in advance to secure your spot. Online booking opens a month before the class.

Timetable Changes: Timetables, coaches, and classes are subject to change. We will notify you as soon as possible if a class is cancelled.

Arrival Time: Arrive before the class begins to ensure you’re ready to start on time. Late arrivals may be asked to warm up before joining the class. Coaches are not required to repeat any information missed by latecomers.

Cancellations: If you need to cancel a class, provide at least 12 hours' notice to allow members on the waiting list to take your place. Repeated late cancellations or no-shows may lead to temporary booking restrictions or additional fees.

Personal Training:

Only coaches and trainers employed by Infinite Gym are permitted to conduct sessions in the gym. External personal trainers or individuals acting as trainers are not allowed.

Our coaches are certified and insured for your safety.

Operating Hours and Maintenance:

Respect the gym’s closing time, which is displayed on our website. Be prepared to leave on time.

We will let you know of any changes to opening hours or scheduled maintenance closures.

Some areas may be temporarily closed for maintenance to ensure the gym is in good condition.

Health:

If you have a medical condition that may affect your safety, please inform our coaches so we can accommodate your needs.

Consequences for Non-Compliance:

Failure to adhere to these rules may result in being asked to leave the gym or, in more serious cases, termination of your membership and involvement of relevant authorities.

At Infinite, we recognise that all members are individuals and may use the gym in different ways. While we maintain high standards of safety and equipment upkeep, exercising carries inherent risks.

Coaches are available to answer questions, offer guidance, and demonstrate equipment usage. Members are responsible for exercising safely and within their capabilities.

As a member, you agree to:
- Only use equipment you know how to use safely. If you're unsure, please seek instruction from the coaches.
- Follow all rules, instructions, and warning notices displayed in the gym.
- Exercise only within your capabilities and take care of your own safety.
- Inform Infinite of any medical condition, injury, or health concern that may impact your ability to exercise safely. Consult your GP if unsure.
- Notify a coach immediately if you feel unwell while exercising.

Purpose of This Code
This Code of Conduct sets out the standards expected from all parents and carers to ensure a safe, positive and supportive environment for every young person taking part in classes or programmes.

1. Supporting a Positive Environment
Parents/carers agree to:
• Encourage positive behaviour — supporting effort, enjoyment and learning, not just performance.
• Promote respect — towards coaches, staff, other parents and all participants.
• Use positive language — avoiding criticism, shouting or negative comments.

2. Safeguarding & Wellbeing
Parents/carers agree to:
• Prioritise participant wellbeing above competition or performance.
• Share relevant medical or wellbeing information to help staff support the participant safely.
• Follow safeguarding procedures and raise concerns appropriately.

3. Communication & Conduct
Parents/carers agree to:
• Communicate respectfully with staff at all times.
• Use official communication channels for questions, concerns or updates.
• Avoid direct messaging coaches outside approved channels.
• Model calm behaviour during sessions, events and competitions.

4. Attendance, Punctuality & Collection
Parents/carers agree to:
• Ensure timely drop‑off and collection.
• Inform staff of authorised collectors and any changes.
• Follow the collection policy, including emergency procedures.

5. Health, Safety & Participation
Parents/carers agree to:
• Ensure the participant arrives prepared with suitable clothing, footwear and hydration.
• Report injuries or illness before sessions.
• Support coaches’ decisions regarding safety, participation and activity modifications.

6. Photography, Filming & Social Media
Parents/carers agree to:
• Avoid posting images of other participants without explicit consent.
• Use social media responsibly and avoid negative or harmful comments.

7. Zero Tolerance for Abuse or Disruptive Behaviour
Parents/carers agree to:
• Avoid aggressive, confrontational or abusive behaviour towards staff, participants or other parents.
• Avoid coaching from the sidelines or interfering with sessions.
• Follow staff instructions in all safety‑related situations.

The organisation reserves the right to remove a parent/carer from the environment if behaviour breaches safeguarding or safety standards.

The organisation also reserves the right to dismiss a parent/carer and their child from a class or programme without refund if any terms of this Code are breached.

8. Commitment
By agreeing to this Code of Conduct, parents/carers confirm that they:
• Understand the expectations outlined above.
• Will support the creation of a safe, positive and inclusive environment.
• Will work in partnership with staff to ensure the best experience for all participants.

This Collection Policy ensures the safe and timely collection of all young people attending any class or programme. It outlines who may collect a participant, how changes must be communicated, and what happens in the event of delays or emergencies.

1. Authorised Individuals
Participants will only be released to individuals named by the parent/carer on the consent form.
Parents/carers must keep this information accurate and up to date.
If someone not listed arrives to collect a participant, staff will:
• decline release
• contact the parent/carer for confirmation
• release the participant only once verbal authorisation is given

2. Identification
Staff may request identification from anyone collecting a participant if:
• they are not known to staff
• they are newly authorised
• there is uncertainty about identity

3. Independent Departure
Participants may leave independently only if explicit written consent is provided on the consent form.
Without this consent, the participant must be collected by an authorised individual.

4. Timely Collection (Strict Requirement)
Parents/carers must collect participants within 10 minutes of the class or programme finishing.
Late collection disrupts staffing, safeguarding ratios and venue operations.
Therefore:
• A late fee may be applied for any collection beyond the 10‑minute window.
• Repeated late collection may result in removal from the class or programme without a refund.

5. Changes to Collection Arrangements
Any change to collection arrangements must be communicated before the session ends via:
• phone call
• email
• in‑person notification at drop‑off
Messages passed through other parents or participants will not be accepted.

6. Emergency Situations
If a parent/carer cannot collect the participant due to an emergency:
• staff must be contacted as soon as possible
• a temporary authorised collector may be nominated
• staff will verify identity before releasing the participant
If no authorised adult can be reached after repeated attempts, staff will follow safeguarding procedures, which may include contacting local authorities.

7. Safety First
Staff will always prioritise participant safety.
A participant will not be released if:
• the collector appears under the influence of alcohol or drugs
• the collector behaves aggressively or inappropriately
• staff have any safeguarding concerns
In such cases, staff will contact the parent/carer or emergency contact or local authorities.

8. Parent/Carer Responsibilities
Parents/carers agree to:
• provide accurate collection information
• update authorised collectors promptly
• ensure punctual collection
• communicate changes clearly
• follow all emergency procedures

Safeguarding:
- All staff are PVG‑checked.
- Infinite follows Children 1st and sportscotland safeguarding standards.
- A Child Protection Officer is available for concerns.

First Aid & Emergencies
- A qualified Sports First Aider is present at all times.
- Staff may administer basic first aid.
- Emergency services may be contacted if required.
- Relevant medical information may be shared with emergency responders.

Behaviour & Physical Contact:
- CrossFit, HYROX and/or hybrid training involves functional movement coaching.
- Coaches may use brief, appropriate physical contact to ensure safe technique.
- Anti‑bullying and behaviour standards follow Children 1st guidance.

Photography & Media:
- Images may be used only according to the consent you select.
- Images will never be shared with third parties or used inappropriately.

Digital Communication:
- Infinite Gym communicates only with parents/guardians.
- No direct communication with children.

Collection & Transport:
- Children are released only to authorised individuals.
- Staff do not transport children except in emergencies.

Data Protection
- Information is stored securely and used only for safeguarding and operational purposes.
- Data can be deleted after the programme ends under the parent or guardian's written request to hello@infinitegym.co.uk.
