1. VOLUNTARY PARTICIPATION
I voluntarily agree to participate in physical training, exercise programs, and related activities provided by Percheron Fitness LLC, including but not limited to strength training, conditioning, mobility work, outdoor workouts, and use of equipment or facilities.
In consideration of being permitted to participate, I release, waive, discharge, and agree not to sue Percheron Fitness LLC, its owners, coaches, staff, contractors, and affiliates from any and all liability, claims, demands, damages, or causes of action arising out of or related to my participation in training, use of the facility, or presence on the premises, whether caused by negligence or otherwise.

2. CHILDREN ON THE PREMISES
I understand that Percheron Fitness LLC is not a childcare provider.
If I bring a child onto the premises, I accept full responsibility for that child’s supervision, safety, and behavior at all times unless the gym has explicitly designated supervised childcare for a specific class or time. I assume all risks related to my child’s presence in the facility and release Percheron Fitness LLC from any liability arising from a child’s use of the premises, including designated child areas.

3. ASSUMPTION OF RISK
I understand that physical training and exercise involve inherent risks, including but not limited to:
• Equipment malfunction or breakage
• Slips, trips, or falls
• Dropping weights or equipment
• Overexertion, dehydration, or heat-related illness
• Outdoor hazards such as uneven surfaces, vehicles, or debris
• Serious injury, disability, or death

I knowingly and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of Percheron Fitness LLC or others.

I acknowledge that I am responsible for monitoring my own physical condition and that it is my responsibility to consult with a physician prior to participation if I have any health concerns. If I choose not to obtain medical clearance, I accept all risks associated with that decision.

4. NO GUARANTEES
I understand that no guarantees have been made regarding results, improvements, or outcomes from participation in any program. Results vary based on effort, consistency, and individual factors.

5. INDEMNIFICATION
I agree to indemnify and hold harmless Percheron Fitness LLC, its owners, staff, and affiliates from any claims, costs, damages, or legal expenses arising from my participation or my child’s presence on the premises.

6. COVENANT NOT TO SUE
I agree that I will not initiate any lawsuit or legal claim against Percheron Fitness LLC related to injuries, damages, or losses arising from participation or presence at the facility, including those involving my child.

7. SEVERABILITY
If any portion of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8. ACKNOWLEDGEMENT
By signing below, I confirm that:
• I have read this agreement fully
• I understand its terms
• I am signing voluntarily
• I understand I am waiving certain legal rights
