Evolve Female Gym (The Bar Health & Fitness LTD) – Membership Waiver, Terms & Conditions
1. General Terms
1.1 By signing this agreement and/or using the facilities at [Evolve Female Gym (The Bar Health & Fitness LTD)] (“the Gym”), you confirm that you understand and accept these Terms & Conditions.
1.2 The Gym operates as a 24/7 access facility. Members are responsible for their own safety and conduct while on the premises.
1.3 The Gym reserves the right to amend these Terms & Conditions at any time. Notice of changes will be provided to members.
2. Assumption of Risk
2.1 You acknowledge that participation in physical exercise and use of gym facilities carries inherent risks, including the risk of serious injury or death.
2.2 You voluntarily assume full responsibility for any risks, injuries, or damages that may occur through use of the Gym facilities and equipment.
2.3 You confirm that you are in suitable physical condition to use the Gym and participate in exercise activities. If you are unsure, you agree to consult a medical professional before starting or continuing exercise.
3. Waiver of Liability
3.1 To the fullest extent permitted by law, [Evolve Female Gym (The Bar Health & Fitness LTD)], its owners, staff, and agents accept no liability for any injury, loss, or damage to persons or property arising out of your use of the Gym.
3.2 This waiver extends to injuries sustained during:
Independent use of the facilities
Participation in group or individual exercise
Any other activity on Gym premises
4. Self-Employed Coaches
4.1 The Gym permits independent, self-employed coaches (“Coaches”) to train clients on the premises.
4.2 Coaches are not employees, representatives, or agents of the Gym.
4.3 The Gym holds no responsibility or liability for any advice, services, or training provided by Coaches. Any agreement for coaching services is strictly between the member/client and the Coach.
4.4 Members acknowledge that any injury, loss, or damages arising from services provided by Coaches are the sole responsibility of the Coach and the member/client.
5. Member Responsibilities
5.1 Members must:
Use equipment in a safe and proper manner
Return all equipment after use
Follow posted rules, signage, and instructions
Refrain from reckless or dangerous behaviour
Not allow access to non-members
5.2 Members are responsible for securing their belongings. The Gym accepts no responsibility for lost or stolen items.
6. CCTV & Media Use
6.1 For security and safety, the Gym premises are monitored by CCTV recording 24/7. By entering the Gym, members consent to being recorded.
6.2 CCTV footage will only be used for security, safety, and operational purposes.
6.3 The Gym may from time to time take photographs or video recordings within the facility for use on its website, social media platforms, and promotional/advertising materials.
6.4 By signing this agreement, you consent to the possible use of your image in such material. If you wish not to be included, you must inform Gym management in writing in advance.
7. Emergency & Safety
7.1 The Gym is monitored remotely for security purposes but is not continuously staffed. Members acknowledge that they are responsible for their own safety while using the Gym outside staffed hours.
7.2 Emergency exits and equipment must only be used in case of emergency.
7.3 Any accidents or injuries must be reported to the Gym management as soon as possible.
8. Membership & Access
8.1 Membership is personal and non-transferable.
8.2 The Gym reserves the right to revoke or suspend membership for breach of these Terms & Conditions.
8.3 Members are responsible for the safe use of their personal entry fob/card and must not share it with others.
9. Governing Law
9.1 These Terms & Conditions shall be governed by and construed in accordance with the laws of Northern Ireland.
9.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
10. Declaration
I release [Evolve Female Gym (The Bar Health & Fitness LTD)], its owners, staff, and agents from any liability as outlined above.
I understand that self-employed Coaches are independent providers, and the Gym has no liability for their services.
I consent to CCTV monitoring for security and safety.
I consent to the use of photos/videos for promotional purposes unless I notify the Gym in writing.
