1. Acknowledgment of Risks

I understand that participation in CrossFit training, weightlifting, gymnastics, metabolic conditioning, and related fitness activities (collectively referred to as “Activities”) involves inherent risks, including but not limited to:

Muscle strains, sprains, and other physical injuries

Accidents involving gym equipment

Heart attack, stroke, or other serious medical conditions

Permanent disability or death

I acknowledge that these risks cannot be completely eliminated, even with proper supervision and coaching.

2. Voluntary Participation

I affirm that my participation in these Activities is entirely voluntary, and I freely assume all risks associated with participation.

3. Health and Fitness Certification

I certify that I am physically fit and have no medical condition that would prevent safe participation. I agree to disclose any health concerns or conditions to the gym staff prior to participation and to stop any activity that causes discomfort or pain.

4. Release of Liability

In consideration for being allowed to participate in the Activities, I hereby release, waive, and discharge CrossFit Newquay Ltd, its owners, coaches, employees, volunteers, and agents (collectively, “Released Parties”) from any and all claims, demands, or causes of action arising out of or related to any loss, injury, or damage sustained by me, whether caused by negligence or otherwise, to the fullest extent permitted by law.

5. Indemnification

I agree to indemnify and hold harmless the Released Parties from any and all claims, including legal fees and costs, brought by or on behalf of me or any third party arising from my participation.

6. Media Release

I grant CrossFit Newquay Ltd permission to use photographs, videos, or other media of me taken during Activities for promotional or marketing purposes without compensation.

If you do not wish to consent to media release please contact the gym director in writing via email. A note will be added to your membership.

7. Minor Participants (if applicable)

If the participant is under 18 years of age, this section must be completed by a parent or legal guardian:
I, the undersigned parent/guardian, consent to my child’s participation and agree to all terms above on their behalf.

The purpose of this questionnaire is to determine if you are ready to safely participate in physical activity or if you should seek medical advice before starting. Please read each question carefully and answer honestly.

1. Introduction

These Terms and Conditions (“Terms”) govern the use of membership services provided by CrossFit Newquay Ltd (“the Gym,” “we,” “our,” or “us”). By signing up for a membership, you (“Member,” “you,” or “your”) agree to comply with and be bound by these Terms.

Please read these Terms carefully before purchasing or using any membership.

2. Membership

All memberships are personal and non-transferable. Members must ensure that their contact and billing details remain accurate and up to date at all times.

By joining, you agree to abide by all applicable policies, rules, and regulations established by the Gym.

3. Membership Fees and Billing

Membership fees are payable in advance of each billing period.

Payments will be processed automatically using the payment method provided at the time of registration and will bill on the 1st day of the month.

Any failed or late payment may result in suspension or termination of membership until payment is received.

4. Membership Changes (Upgrades or Downgrades)

Members may request to upgrade or downgrade their membership with 30 days written notice.

Membership changes cannot be made within an active billing cycle.

The requested change will take effect after the current billing period ends and the 30-day notice period has passed.

Any difference in fees between membership levels will be prorated as applicable.

5. Cancellation Policy

Members may cancel their membership by providing 30 days written notice.

Cancellations will take effect 30 days after notice is received or at the end of the current billing cycle, whichever is later.

Members remain responsible for all fees due during the 30-day cancellation period.

Membership access will remain active until the cancellation becomes effective.

No refunds will be provided for unused portions of a billing cycle or prepaid fees unless otherwise agreed.

6. Suspension or Termination by the Gym

We reserve the right to suspend or terminate memberships for:

Breach of these Terms or any Gym rules and policies;

Conduct that is unsafe, disruptive, or inappropriate toward other members or staff; or

Failure to pay membership fees.

If membership is terminated for misconduct or breach, no refund will be issued.

7. Gym Rules and Code of Conduct

Members must:

Follow all posted Gym rules, staff instructions, and safety guidelines.

Use all equipment and facilities properly and respectfully.

Maintain appropriate hygiene at all times.

Not share entry codes, or permit unauthorised access.

The Gym is not responsible for loss, theft, or damage to personal belongings.

8. Facility Availability

The Gym may temporarily close or restrict access for maintenance, cleaning, holidays, or other operational reasons.
Reasonable notice will be provided where possible. Such closures do not entitle members to refunds, credits, or extensions.

9. Privacy and Data Protection

The Gym collects and processes personal information in accordance with applicable data protection laws.

10. Changes to Terms

We may update these Terms periodically. Members will be notified of any material changes in advance. Continued use of the Gym after notification constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in England and Wales.
