PARTICIPATION WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK

The Fieldhouse

1. Assumption of Risk
I acknowledge that participation in physical training activities at The Fieldhouse—including but not limited to strength training, conditioning, weightlifting, Olympic lifting, gymnastics-style movements, running, plyometrics, cardiovascular training, open gym, personal training, and semi-private training—involves inherent risks.
These risks include, but are not limited to:
- Muscle strains, sprains, and tears
- Joint injuries
- Cardiovascular events
- Falls or collisions
- Equipment malfunction or misuse
- Exacerbation of pre-existing conditions
I understand that these risks may result in serious injury, permanent disability, or death, and I voluntarily choose to participate.

2. Supervised Open Gym Acknowledgment
I understand that while open gym sessions are supervised, supervision does not eliminate risk. I am solely responsible for selecting appropriate movements, loads, intensity, and rest periods, and for exercising within my personal limits.

3. Health & Medical Representation
I affirm that:
- I am physically capable of participating in exercise activities.
- I have disclosed any known medical conditions, injuries, or limitations that may affect my participation.
- I understand it is my responsibility to consult a physician before beginning any fitness program.
- This includes, but is not limited to, individuals who are pregnant, postpartum, older adults, or participating with adaptive or modified needs.

4. Release of Liability (Arizona)
In consideration of being allowed to participate, I hereby release, waive, and discharge The Fieldhouse, its owners, coaches, employees, independent contractors, agents, and volunteers from any and all claims, demands, or causes of action arising out of injury, illness, or damages sustained during participation, including those arising from ordinary negligence, to the fullest extent permitted under Arizona law.

5. Indemnification
I agree to indemnify and hold harmless The Fieldhouse from any claims, damages, or expenses arising from my participation.

6. Communicable Disease Acknowledgment
I understand that participation in group fitness activities may increase the risk of exposure to communicable diseases, including but not limited to COVID-19. I voluntarily assume this risk and agree that The Fieldhouse is not responsible for illness resulting from participation.

7. Media Release (Opt-Out)
I grant permission for The Fieldhouse to use photographs or video recordings of me for promotional, educational, or marketing purposes.
If I wish to opt out, I understand it is my responsibility to notify The Fieldhouse in writing.

8. Arbitration Agreement
Any dispute, claim, or controversy arising out of or relating to this agreement or participation at The Fieldhouse shall be resolved exclusively through binding arbitration in Pima County, Arizona, in accordance with the rules of the American Arbitration Association.
I understand that by agreeing to arbitration, I am waiving my right to bring claims in court or have a jury trial.

9. Severability
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

10. Electronic Signature
I understand and agree that this waiver may be executed electronically. My electronic signature is legally binding and has the same force and effect as a handwritten signature.
