Wyvern Fitness Ltd collects and processes information about members. We do this to enable us to ensure we have the best and most relevant and up to date information we need to advise you with regard to exercise, and to help you get the best out of your time spent here, and also to process payments. We will only keep information about you which is relevant to your use of our facilities and will only keep information which you provide for as long as is necessary. You can request us to delete the data we hold. If you decide that you no longer wish us to retain this information then please request that we delete your data via email, letter, text or verbally. Contact details can be found on our website. You are also entitled to request to see the information we hold on our systems - please ask via email, letter, text or verbally.

The Data Protection Act 1998 and subsequent General Data Protection Regulation requires us to obtain your agreement before we can process this information. Please sign to give your consent to us keeping and processing the information that you provide and that you have read the above statements regarding the information we hold about you.

In consideration of being allowed to participate in the activities and programmes of Wyvern Fitness Ltd and to use the facilities and equipment owned and/or under the control of Wyvern Fitness Ltd, in addition to the payment of any fee or charge, I hereby waive, release and forever discharge Wyvern Fitness Ltd from any and all responsibility or liability for injuries or damages resulting from my participation in any activities or my use of equipment or facilities; including the spa.

I understand and I am aware that strength, flexibility, aerobic exercise, class participation and use of spa plus the use of equipment are potentially hazardous activities. I also understand that exercise and fitness activities and spa use involve a risk of injury and even death. In particular, I acknowledge and agree that the athletic activities I will be participating in require a high degree of effort, are designed to be high intensity, and are intended to challenge my cardiovascular endurance, stamina, strength, flexibility, power, speed, agility, accuracy, balance and coordination. I acknowledge and agree that I am voluntarily participating in these activities and using equipment and facilities (including the spa) with the knowledge of the dangers involved.

I understand that although Wyvern Fitness Ltd will take steps to reduce the risks and increase the safety of all athletic activities and use of facilities, it is not possible for Wyvern Fitness Ltd to make these athletic activities completely risk free. I also acknowledge that I am personally responsible for my preparation prior to athletic activities, my concentration and attention during these athletic activities, and for my post activity rest and recovery; plus my preparation and use of the spa.

I confirm that I have and will continue to honestly represent my level of fitness, health, nutrition, use of medication, medical history, and current physical, mental, and medical condition to Wyvern Fitness Ltd. I understand that Wyvern Fitness Ltd is not able to and will not provide me with medical advice with regard to any medical conditions I may have and that the information I provide to it is used only as a guideline to the limitations of my ability to exercise.

I hereby declare myself to be physically sound and suffering from no condition, impairment, disease or infirmity or other illness (other than those declared to Wyvern Fitness Ltd) that would prevent my participation in or use of equipment or facilities.

I acknowledge that I have either had a physical examination and have been given my doctor’s permission to participate, or that I have decided to participate in activity and use of equipment/machinery and the spa without the approval of my doctor and do hereby assume all responsibility for my participation and activities, and utilisation of equipment/machinery and all facilities in my activities.

I confirm that I will learn and obey the rules and regulations and terms and conditions of Wyvern Fitness Ltd, and that I will follow the instructions and directions of Wyvern Fitness Ltd during athletic activities and use of equipment and facilities. I will also inform Wyvern Fitness Ltd immediately should I feel pain, discomfort, fatigue, nausea or other symptoms that I may suffer during and immediately after athletic activities or use of any facility. I consent to receiving first aid and medical treatment by Wyvern Fitness Ltd in the event of an accident, injury or illness during athletic activity or use of facilities.

I understand that from time to time Wyvern Fitness Ltd may use media in the form of photography and videography to promote Wyvern Fitness Ltd online and through other forms of advertising. I confirm that I will tell Wyvern Fitness Ltd in advance if I do not wish for any imagery of myself to be used otherwise I understand I am giving permission for my image to be use in the promotional manner stated above.

I agree that this agreement and any rights, duties and obligation as between the parties to this agreement shall be governed by and interpreted solely in accordance with the laws of the United Kingdom of Great Britain and Northern Ireland.
I confirm that I am over the full age of eighteen (18) years and that I have read this agreement/waiver prior to signing it and that I understand it.

Whilst physical activity is a cornerstone of a healthy lifestyle, it is subject to risk. We urge you to seek advice from your doctor before participating in any exercise activity. In particular, if the answer to any of the following questions is ‘YES’, talk your doctor about those questions and follow their guidance.

It is your responsibility to ensure that you are safe and capable to use any of the facilities here.

Has your doctor ever said that you have a heart condition and that you should only do physical activity recommended by a doctor?

Do you feel any pain in the chest when you do physical activity?

In the past month, have you had any chest pains when you were not doing physical activity?

Is your doctor currently prescribing you medication for blood pressure or a heart condition?

Do you ever lose balance because of dizziness, or do you ever lose consciousness?

Do you have any bone or joint problems that could be made worse by a change in physical activity?

Have you suffered from any major illness or had any major surgery in the past 2 years?

Are you pregnant or have you recently had a baby?

Do you smoke?

Are there any medical issues that could increase your risk of illness or injury as a result of physical activity?

Do you know of any other reason why you should not participate in a program of physical activity?

In the event of an emergency, is there any impairment or condition which requires you to need assistance to safely evacuate the building quickly?

This waiver is in conjunction with the declared injuries & illnesses form you completed on arrival at Crossfit Watford.

CrossFit Watford Ltd Membership Terms & Conditions

Principle Terms

1. The agreement starts:
If you are already at the gym, once you have indicated your acceptance in the Declaration section of this web sign-up process.
OR?
If you are not at the gym, once you have indicated your acceptance in the Declaration section of this web sign-up process and then entered the gym premises or after a period of seven days has passed – whichever is sooner.
2. Your membership starts immediately.
3. You will be entitled to the rights and privileges of the Membership type chosen.

Fees and Charges

1. Foundation course/Beginners classes must be attended for any member that has not partaken in CrossFit before or CrossFit Watford staff feel is not capable of performing all movements confidently and safely. This charge includes giving you access to our fundamentals class to set you off on the right track.
2. The direct debit Payment Amount is due from you to us. You are obligated to make the first direct debit when the membership commences. You are obligated to make every Direct Debit payment, regardless of non-attendance except where the cancellation terms below or any terms which are specified on-line are met.
3. You agree to promptly advise us of any changes to the Member Details provided.

Renewal

1. Once you have completed the minimum number of Direct Debit payments, we will automatically continue to collect the Direct Debit Payment Amount every month unless you cancel (in which case you need to give us not less than 30 days’ notice). Your membership will be extended by one month each payment (“Renewal Period”). This Renewal Direct Debit Payment Amount may only be amended if we advise you in writing giving no less than 30 days’ notice.
2. During this Renewal Period you can cancel by cancelling your Direct Debit with CrossFit Watford – just provide us with the 30 days’ notice as stated above.

Cancellation and Freezing Membership

1. Should an injury or extended period away arise and you require your membership to be frozen, you must give us 10 working days notice for this to be completed. Pauses/freezes in membership will occur a £10 weekly admin charge . Cancellation or freeze notice must be given in writing by email or letter.
Cancellations and rejoins within a 4 month period will be subject to a £50 rejoining fee.

Cancellation of an individual class must be done more than 6 hours prior to the start of the class otherwise that session will be lost.

1. Yearly price increases.
All memberships are subject to a yearly price increase in line with inflation.

General Terms

1. You agree to comply with the Gym Etiquette which is displayed in the club. We may make reasonable changes to these rules if we feel it will benefit the gym as a whole. If non-compliance with Gym Etiquette consistently causes damage to equipment, distress or disturbance to other members/staff we will need to discuss the issue with you and reserve the right to terminate this agreement.
