AGREEMENT, WAIVER, RELEASE OF CLAIMS, WARNING OF RISK AND ASSUMPTION OF RISK
PARTICIPANTS: READ THIS DOCUMENT CAREFULLY BEFORE SIGNING. THIS DOCUMENT HAS LEGAL CONSEQUENCES. IT WILL AFFECT YOUR LEGAL RIGHTS AND WILL LIMIT OR ELIMINATE YOUR ABILITY TO BRING FUTURE LEGAL ACTIONS.

I understand and acknowledge that by checking the box below or signing below, I am legally agreeing to all of the following statements in exchange for being permitted to participate in activities at The Yard Strength & Fintess

I understand that participating at The Yard Eccleston is a hazardous activity.
I acknowledge that training and participation at The Yard Eccleston is a test of physical and mental limits and carries inherent risks of physical injury that cannot be completely eliminated, including but not limited to serious injury and/or death.

I expressly, knowingly, and voluntarily assume all risks of participating at The Yard Eccleston.

These risks include, but are not limited to:
Falls
Illness or infection
Contact or collision with other participants of varying skill levels
Contact with equipment, fixed objects, or surfaces
Equipment malfunction
Slips or trips
Physical overexertion
Weather conditions where applicable
Imperfect training conditions

I understand that these risks may result in:
Minor to severe bodily injury
Temporary or permanent disability
Paralysis
Illness
Death
Property damage or loss

I understand that risks may arise from:
My own actions or inactions
The actions or inactions of other participants
The actions or inactions or negligence of The Yard Eccleston, its staff, contractors, or volunteers (the “Released Parties”)

I accept full responsibility for the condition and adequacy of my personal equipment.
I expressly assume all risks and take full responsibility for any and all damages, liabilities, losses, or expenses incurred as a result of my participation.

Health Declaration
I agree that it is my responsibility to determine whether I am sufficiently fit, healthy, skilled, and physically prepared to safely participate.
I confirm that I am (or the under 18 I am signing on behalf of is), on the date of signing, in good health and proper physical condition to safely participate.

I confirm that I have no known medical or mental condition that would:
Affect my ability to safely participate
Create risk to myself or others
I confirm that I have not been advised otherwise by a medical professional.
I understand I am strongly advised to consult a medical practitioner before participating, especially if pregnant, recovering from illness, injury, or managing a medical condition.

I agree to monitor my own physical and mental condition during training and will stop immediately and inform a coach if I feel unsafe to continue.
I understand that membership fees are paid in exchange for the opportunity to participate and are non-refundable if I withdraw.

Alcohol & Drugs
I understand the dangers associated with alcohol and/or drug use and certify that I will not participate while under the influence of any substance that may impair my judgment or motor skills.
I accept full responsibility for any injury, loss, or damage resulting from alcohol or drug use before or during participation.
Code of Conduct
I agree to abide by all rules of The Yard Eccleston and comply with directions from coaches and staff, including:
Follow coaching instructions and complete workouts as directed.
Maintain appropriate behaviour at all times.
No verbal abuse, harassment, or deliberate distraction of coaches or members.
Work hard for yourself and support others.
Be respectful and inclusive of all members.
Treat everyone as you wish to be treated.
Respect all participants regardless of gender, ability, cultural background, or religion.

I understand The Yard Strength & Fitness may dismiss any person whose behaviour:
Endangers safety
Violates rules
Damages property
Negatively affects others
Parents / Guardians (Under 18 Participants)

If signing on behalf of a participant under 18, I acknowledge and agree:
Children participate for enjoyment.
I will encourage, not force, participation.
I will promote respect and good sportsmanship.
I will respect coach decisions.
The coach’s decision during sessions is final.

Only The Yard Strength & Fitness may use recording devices during youth sessions for promotional purposes.

Medical Consent
In the event of injury, accident, or illness, I consent to receive medical treatment deemed appropriate by The Yard Eccleston staff and/or medical professionals.
I accept full responsibility for any associated medical costs including:
Ambulance services
Hospital treatment
Medical care
Medication

Photography & Media Release
I grant permission to The Yard Strength & Fitness to use photographs, videos, or recordings of my participation for legitimate purposes, including marketing, advertising, and social media.
I understand that all such media becomes the property of The Yard Eccleston and may be used without compensation.

Release & Indemnity
I hereby waive, release, and forever discharge The Yard Eccleston and its directors, officers, employees, contractors, volunteers, insurers, and representatives (“Released Parties”) from all claims arising from my participation.

This includes claims relating to:
Personal injury
Disability
Death
Property damage
Negligence
I agree not to bring legal action against the Released Parties.

I agree to indemnify, defend, and hold harmless The Yard Eccleston from any claims or expenses arising from:
My breach of this Agreement
My failure to follow rules or instructions
My actions are causing injury or damage

This agreement applies to me and my heirs, family members, legal representatives, and assigns.

Membership Terms
I acknowledge and agree to the membership terms provided at sign-up.
If cancelling before the end of a minimum commitment period, The Yard Eccleston reserves the right to charge any applicable early termination fee as stated in the membership agreement.
I understand that required notice must be provided in writing or by email prior to cancellation and that billing will continue during the notice period.
Governing Law
This Agreement is governed by the laws of the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the UK courts.
If any provision of this Agreement is deemed unenforceable, the remaining provisions remain valid.

Memberships at The Yard may be paused for a minimum period of one (1) full calendar month and a maximum of two (2) consecutive calendar months per request. At the end of the approved pause period, the membership will automatically reactivate and resume normal billing unless otherwise agreed in writing prior to the reactivation date. Members are permitted to pause their membership a maximum of two (2) times within any twelve (12) month period. Pause requests must be submitted in writing in advance of the intended start date and are subject to management approval.

Declaration
BY SIGNING BELOW, I CONFIRM THAT:
I AM 18 YEARS OF AGE OR OLDER (OR SIGNING ON BEHALF OF AN UNDER 18 PARTICIPANT).
I HAVE READ AND UNDERSTAND THIS AGREEMENT.
I VOLUNTARILY AGREE TO ITS TERMS.
I agree to the above information.
